What the inspector wrote

Licensing Program Analyst (LPA) Roxana Lopez conducted a Case Management-Deficiencies visit on this date to address deficiencies revealed during a Case Management inspection. LPA toured facility by themselves as the Director was covering in the preschool classroom. Census was taken. Upon entering the facility LPA observed 11 infants with 2 staff. 8 of the infants were observed to be sitting in high chairs, with no adult supervision. Some of the infants were eating and others were waiting for food. LPA observed 1 teacher in the classroom behind the baby gate with 2 infants. From the kitchen area LPA observed a teacher assistant walking towards the infants in high chairs with plates of food. The area where high chairs are located is not visible from the kitchen or classroom which was where both staff were located. LPA toured the nap room and observed 1 infant asleep with no supervision and both doors of nap room closed. LPA looked at cameras and noticed that the area where infant was sleeping is not viewed in cameras. Per Teacher they check on the child through the side door. LPA did not observed a current sleep log. This poses an immediate health and safety risk for children in care. Based on LPA observations and records review, the following deficiencies listed on the attached LIC 809D (deficiency page) are being cited in accordance with California Code of Regulations Title 22. Deficiencies that are being cited need to be cleared to protect the children\342\200\231s health and safety. LPA Roxana Lopez informed Facility Representative Elodia Barnhart that this report dated 2/22/2024 document(s) 2 Type A citation(s) which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care.------------------pg. 1 of 2 Also, LPA Roxana Lopez informed the Licensee to provide a copy of this licensing report dated 2/22/2024 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. This requirement was not met as eveidenced by Based on observation, LPA observed 11 infants present with only 2 staff in the classroom which poses an immediate health and safety risk to children in care.

  • RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION FOR INFANTS

    101429 (a) In add.. to Sec. 101229, the following shall apply:(1)Each infant shall be constantly supervised and under direct visual observation and supervision by a staff person at all times. This requirement is not met as Based on observation, LPA observed 8 unsupervised infants in high chairs and 1 infant unsupervised in the nap room with both nap room doors closed which poses an immediate health and safety risk to children in care.

  • 10429(2)(b)Type B

    101429 Responsibility for Providing Care and Supervision for Infants (2) Sleeping infant(s) shall be directly observed by sight and sound at all times.(B)Staff shall physically check on sleeping infant(s) every 15 minutes. This requirement was not met as evidenced by Based on observation, LPA observed that their was no current sleep log for infant observed to be sleeping in the nap room, which poses an immediate health and safety risk to children in care.

    101700.3(b)(1)California Lead Action Level at Child Care Centers. (b) Testing results with...readings of 0.5 ppb or greater.., before comparing to the Action Level. (1) A result with values of 5.5 ppb or greater shall be deemed an Action Level Exceedance. This requirement is not me at evidenced by Based on ispection, the licensee did not comply with the directive above, as that water fountain (D) tested with an Action Level Exceedance (ALE) of 13.00 ppb. This poses a potential health and safety risk to children in care
