What the inspector wrote

Licensing Program Analyst (LPA) Roxana Lopez conducted an unannounced case management inspection for an Action Level Exceedance (ALE) detected in a water fixture in the facility. A COVID 19 risk assessment was conducted prior to entering the facility. LPA met with facility Director Elodia Barnhart during the visit. Census was taken Analyst reviewed new Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, which requires the testing of water for lead in Child Care Centers (CCCs) with facility director during the inspection. Per AB 2370, all CCCs that are located in buildings constructed before January 1, 2010, must have their water tested and post the results by January 1, 2023, and every 5 years after the date of the first testing. Facility provided facility sketch and required forms LIC 9276, LIC999 and LIC 9275 to the department. On 11/27/2023, the Department received notification from the State Water Resources Control Board(SWRCB), Division of Drinking Water (DDW). The SWRCB report indicated the facility was inspected and samples were collected on 10/7/2023. Faucets reported with 5.5 ppb or greater lead exceedance levels were as follows: -------------------------------------------------- pg. 1 of 2 -------------------------------------------------- Playground water fountain (D) (13.00 UG/L) \342\200\223 During inspection LPA observed water fountain is covered and off limits. Pictures were taken Director stated that this water fountain is not used by children and it will be removed. Per Director children bring their own water bottles from home. Grant funding will be available for testing and remediation of lead to the Child Care Centers that qualify. To make a determination of eligibility, refer to PIN 21-04-CCP. A notice of site visit was also provided and must remain posted for 30 days . Failure to comply with posting requirements shall result in an immediate civil penalty of $100. This requirement was not met as eveidenced by Based on observation, LPA observed 11 infants present with only 2 staff in the classroom which poses an immediate health and safety risk to children in care.

  • RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION FOR INFANTS

    101429 (a) In add.. to Sec. 101229, the following shall apply:(1)Each infant shall be constantly supervised and under direct visual observation and supervision by a staff person at all times. This requirement is not met as Based on observation, LPA observed 8 unsupervised infants in high chairs and 1 infant unsupervised in the nap room with both nap room doors closed which poses an immediate health and safety risk to children in care.

    101429 Responsibility for Providing Care and Supervision for Infants (2) Sleeping infant(s) shall be directly observed by sight and sound at all times.(B)Staff shall physically check on sleeping infant(s) every 15 minutes. This requirement was not met as evidenced by Based on observation, LPA observed that their was no current sleep log for infant observed to be sleeping in the nap room, which poses an immediate health and safety risk to children in care.

This requirement is not me at evidenced by Based on ispection, the licensee did not comply with the directive above, as that water fountain (D) tested with an Action Level Exceedance (ALE) of 13.00 ppb. This poses a potential health and safety risk to children in care
