What the inspector wrote

Allegation- Staff handled day care child in a rough manner. According to the RP, during a birthday celebration S10 was observed pulling C1 from the arm (unknown which arm) off the table in a rough manner. No additional information was provided by the RP. Interviews conducted with S5 revealed that while changing diapers they observed C1 and another child (name unknown) behind furniture and asked S10 for assistance. According to S5, they heard S10 tell C1 that it was time to get up and denied seeing S10 handle C1 in a rough manner. Interviews conducted with S10 revealed that they didn\342\200\231t recall pulling C1 off the table during the birthday celebration on 09/05. S10 corroborates that while S5 was changing diapers they asked for assistance as C1, and another child were behind furniture. S10 immediately assisted and observed C1 and the other child behind a shelf wedged in that was moved which created a gap. S10 went around C1 and extended their hand so that C1 could grab their hand to help them get up. According to S10, they do not recall grabbing C1 and demonstrated to LPA during the interview how they assisted C1 in getting up. LPA observed the following: S10 leaned at a lower level, extended their hand, C1 grabbed S10s hand and used their feet to get up (S10s statement). Interviews conducted with S1, S2, S3, S4, S6, S7, S8, and S9 did not reveal any information that corroborate the allegation. LPA couldn\342\200\231t interview children as they are infant/toddlers. LPA conducted interviews with P1 thru 6 who made disclosures. Interviews conducted with P1 revealed that on 09/05 they observed S10 pulling/yanking C1 from the arm (unknown arm/side) off the table in a rough manner. P1 does not believe that S10s intention was to hurt C1; however, they expressed that children should be handled in a safe manner utilizing both hands to prevent any injuries. Interviews conducted with P2 and P4 revealed that they don\342\200\231t have any issues or concerns regarding staff. LPA attempted to interview P3, P5, and P6; however, P3 and P6 did not return LPAs call and P5 declined LPAs interview. This agency has investigated the complaint alleging \342\200\234Staff handled day care child in a rough manner.\342\200\235 LPA found conflicting statements regarding the allegation and therefore have found the complaint to be deemed UNSUBSTANTIATED. Meaning that, although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred. A notice of site visit was given and must remain posted for 30 days. An exit interview was conducted, and a copy of this report was provided to the facility representative Stephanie Garcia.
