What the inspector wrote

Licensing Program Analysts (LPA) Cynthia Reyes conducted an announced Case Management inspection on this date for the purpose of to verify that the licensee received and has abided by the letter regarding, S herry Keller : ORDER TO INDIVIDUAL/FACILITY OF IMMEDIATE EXCLUSION. Upon arrival LPA met with Director, Ellen Head and the nature of the inspection was discussed. LPA advised Director that as of April 26,29024 , Sherry Keller is excluded from Hope Lutheran Preschool and any other facility licensed by Department of Social Services. Director was advised that the immediate exclusion letter is a public document. The Director was advised of the appeal process for this exclusion . Director Head stated she received the Exclusion letter handed to her by the church school administrative staff on Monday, April 29, 2024. The letter was by certified mail and dated on the front of the envelope 04/26/2024. Director Head stated she read and understood the letter. Director Head stated she has not terminated Sherry Keller or disassociated her from the facility as of this date, due to Sherry Keller having her court date today 05/08/2024 and was waiting on the Board of the schools instructions. LPA informed Director Head, due to the Immediate Exclusion order, she has 24 hours to comply as she has not complied with the departments decision as of this date. Director Head stated Sherry has been on administrative leave as of 12/13/2024 and has not return to the facility. Sherry Killers child is in care, however Sherry does not and will not pick up or drop off her child as she is excluded from the day care. Director Head stated Sherry's husband and the child grandparents do pick up and drop off. (Copy of child's ID emergency form was obtained on this date). Page 2 The facility had an informal office meeting on 04/092024 with director Head and she had agreed to to contact her local R&R (Pomona Unified) to seek professional services that will assist her with reviewing the facility noncompliance history and assist with any appropriate training's and recommendations to maintain compliance with the state laws and regulations. Director Head stated she has not complied with this request as of this date. Director Head also stated she has not complied with this requirement. LPA advised Director Head she has a week to comply with the request from the informal meeting by Wednesday May 15, 2024. Director Head is to submit in writing by Email, details of what she viewed and learned regarding each of the videos she viewed and Who she spoke with at the R&R, when, and what information she received and what she will be utilizing with the professional services and when. If all the corrections are not made on the date given to b completed by the department the department will then issue citation and hold a Non-compliance conference with the facility and legal action maybe taken. A copy of the 101208 Exclusions and Health and Safety code Regulation was provided to Director Head on this date. Exit Interview conducted with Director, Ellen Head. Notice of Site Visit (LIC 9213) posted and – must remain posted for 30 consecutive days. Failure to maintain posting as required will result in a civil penalty of $100.00. A copy of Appeal Rights was explained and provided.

    Limitations on Capacity and Ambulatory Status. The licensee shall not exceed the conditions, limitations and capacity specified in the license. Based on interview and LPA observation of documents, an infant had been enrolled and in care and commingling with preschool children for about a month before he turned 2 years old. This poses an immediate health and safety risk to the children in care.

    Personnel Records. Personnel records shall be maintained on the licensee, administrator, and each employee, and shall contain specified information. This requirement is not met as evidenced by no current copy of the Personnel Report (LIC 500). This poses a potential health and safety risk to the children in care.

  • SIGN IN AND SIGN OUT

    Sign In and Sign Out (b) The person who brings the child to, and removes the child from, the center shall sign the child in/out. This requirement is not met as evidenced by: Based on LPA observation, the licensee did not comply with the section cited above. There were 40 children in care and 4 were not signed in, which poses/posed a potential health, safety or personal rights risk to persons in care.

    Current Roster of Children Provided Care in Facility Required: Each child day care facility shall maintain a current roster of children who are provided care in the facility. This requirement was not met as evidenced by the facility not having a complete roster available. This poses a potential risk to the health and safety of children in care.
