What the inspector wrote

On 04/01/2026 Licensing Program Analyst (LPA) Cristina Castellanos conducted an unannounced Case Management Inspection at the above-mentioned facility for the purpose of ensuring the standards are being met in accordance with California Tittle 22 Regulations and California Health and Safety Codes. Upon arrival, LPA met with staff member S1, who granted entry to the facility. Shortly thereafter, LPA was greeted by Interim Preschool Director/Pre-K Teacher Laura Martinez, and the purpose of the visit was explained. LPA conducted a tour of the facility and observed twenty (20) children in care with four (4) staff members providing supervision. During the visit, it was observed that the private school continues to store transitional kindergarten (TK) materials, equipment, and other items inside the licensed preschool classroom (Wildcats). The licensee was previously informed that the preschool classroom is approved solely for the licensed preschool program and may not be used for storage or access by the Riviera Hall Lutheran School (RHLS) . Despite prior guidance, the noncompliant activity is ongoing and requires corrective action to ensure the classroom is used exclusively for the licensed preschool program and that access is limited to authorized preschool staff. The continued use of the preschool classroom by RHLS is not in compliance with Title 22 regulations regarding the use of licensed space - Type B . Continue Additionally, it’s noted that the preschool program’s Director Dorian Theberge last day of employment was 2/27/2026 . Since that time, the Interim Director Laura Martinez has assumed full-time responsibility for the director’s role while simultaneously serving as the lead teacher in a preschool classroom . This staffing arrangement does not align with Title 22 requirements, which mandate that a qualified director must be available to perform director-specific duties and may not be assigned as the full-time lead teacher in a classroom. LPA informed Interim Director Martinez of this requirement, and corrective action is still needed to ensure compliance with staffing and administrative regulations. Licensee will ensure the matter is resolved by April 30, 2026 : § Ensure that a qualified director is appointed and available to perform all required administrative, supervisory, and operational duties as outlined in Title 22 regulations. § Remove the Interim Director from full-time classroom teaching duties so that director-specific responsibilities can be carried out in accordance with regulatory requirements. Pursuant to Title 22, Division 12, Chapter 1 of the California Code of Regulations, one (1) deficiency is cited for violations of Title 22 requirements. The deficiency is documented on the LIC 809-D (Type B). An exit interview was conducted, and the Plan of Correction was reviewed with Interim Director Laura Martinez. A copy of this report and the Appeal Rights were provided to Interim Director Laura Martinez, whose signature acknowledges receipt of these documents. Page 2
