Inspector’s narrative

What the inspector wrote

On 9/6/2023 interviews of staff and director were initiated. On 11/21/2023 interviews of all relevant parties were completed. On 8/28/2023 at approximate 4:40 pm , one teacher was left supervising 5 infants; 4 infants from the cuddle bug room and 1 infant from the sunflower room. On 11/21/2023 at 12:05 LPA observed 4 sleeping infants with 6 other infants supervised by 2 staff members. At approximate 12:20 Director arrived at the classroom which allowed classroom to met ratios. Based on LPAs interviews which were conducted and record review(s), the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. California code of Regulations, Title 22, Division 12 & Chapter 1, are being cited on the attached LIC9099D. Exit interview was conducted and a copy of the report was provided with appeal rights to Violet Edward Ferguson.

    101416.5(b) Staff-Infant Ratio, there shall be a ratio of one teacher for every four infants in attendance.This requierment is not met as evidenced by: Based on observation, interview and record review, 1 out of 2 infant classroms was out of ratio on 8/28/2023, one teacher supervising 5 children, which poses an immediate or Health and Safety, and personal rights risk to persons in care.
