What the inspector wrote

During the investigation at approximately 8:51am Site Supervisor Lutu led LPA Castellanos on a tour of the outdoor playground. Site Supervisor informed LPA Castellanos that Pre-K classrooms 1 through 3 were all combine in the outdoor playground. LPA Castellanos observed 25 children in care with only 2 staff members S3 & S2 providing care and supervision. At 9:01am LPA Castellanos then mentioned to Site Supervisor Lutu there was only 2 staff members and 25 children in the playground. Site Supervisor Lutu got on her walkie talkie and called for an additional staff member to report to the playground. At 9:08am LPA Castellanos observed 25 children in care with 3 staff members providing care and supervision and proceeded with the tour of the facility. On 01/16/2025 at 04:41 p.m., officer of the day Licensed Program Analyst (LPA) Cristina Castellanos received a call from Aolelani Lutu, Site Supervisor in connection to an Unusual Incident that occurred at the facility in regard to a child being left unattended from 7:54am to 9:15am. Through documentation, interviews, and a physical plant inspection of the site of the incident, it was revealed that at the time of the incident while the children were transitioning from the PreK1 classroom (the receiving room) to PreK3 (breakfast room) staff members S8 and S1 left a child (C1) unattended in the PreK1 classroom. At approximately 9:15am the classroom’s staff member (S10) found C1 sleeping in the classroom alone. C1 was left unattended for approximately 1 hour and 21 minutes. Per the Site Supervisor Lutu, C1’s parents were notified on Wednesday January 22, 2025 due to parents requiring a Spanish translator. Based on observation, record review and interviews of all relevant parties, it was found that the facility has been operating out of ratio and staff left a child unattended, the preponderance of evidence standard has been met, therefore the above allegations are found to be SUBSTANTIATED. There were two deficiencies cited during today’s visit in accordance with the California Code of Regulations, Title 22, Division 12, and Chapter 1. See LIC 9099-D for additional information. As well as a Civil Penalty Assessment - Immediate. Page 2 Upon receipt of this report, the Licensee shall post the Notice of Site Visit and any Licensing report documenting a Type “A” deficiency. The report and the Notice of Site Visit shall be posted for 30 consecutive days. Failure to maintain posting as required, will result in an immediate $100 civil penalty. A copy of this report shall be provided to the parent/guardian of children currently enrolled by the next business day or immediately upon return. A copy of this report shall also be provided to the parent/guardian of any newly enrolled children for the next 12 months (1 year). The Acknowledgment of Receipt (LIC9224) form must be maintained in each child’s file immediately upon receipt from parent. Licensee was provided with a copy of the Acknowledgement of Receipt of Licensing Reports (LIC 9224) Form during this visit. An exit interview was conducted, and Plan of Corrections were reviewed and developed with the Site Supervisorr. A copy of this report and appeal rights were discussed and left with the Site Supervisor, whose signature on this form confirm receipt of these documents. Page 3

During today's inspection LPA observed 25 children in care with 2 adult staff members providing care and supervision, which poses/posed an immediate health, safety or personal rights risk to persons in care.

    101229(a)(1) Responsibility for Providing Care and Supervision (a) The licensee shall provide care and supervision as necessary to meet the children's needs.(1) No child(ren) shall be left without the supervision of a teacher at any time... Supervision shall include visual observation.This requirement is not met as evidenced by: Based on documentation review and interviews that were conducted the facility did not comply with the section cited above, one child was left alone for approximatetly 1 hour & 21 minutes in the PreK1 classroom, which poses/posed an immediate health, safety or personal rights risk to persons in care.
