What the inspector wrote

On 6/9/21 Licensing Program Analyst (LPA) Jeanette Estrada conducted an uannounced complaint inspection to the above facility. LPA met with Ana Fragoso-Tovalin- Director, and went over the findings. At the time of arrival there were 48 children present with 4 staff. LPA toured the facility on 5/4/21 and observed children eating indoors, not on playground tables. LPA conducted staff interviews which provided conflicting information. The complainant was not available for interview. Based on interviews conducted and the information obtained, the above allegation is unsubstantiated. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore these allegations are unsubstantiated. Exit interview was conducted with Ana Fragoso, Director. The Notice of Site Visit (LIC 9213) – must remain posted for 30 days during the hours of operation after each site visit by a licensing representative. Failure to maintain posting as required will result in a civil penalty of $100.00. Exit interview was conducted with Ana Fragoso, Director.

    THIS IS AN AMENDED REPORT101216.3(a)Teacher-child ratio.There shall be a ratio of one teacher visually observing and supervising no more than 12 children in attendance. This requirement was not met as evidenced by; Based on interviews and records reviewed, the facility was over on more than one occasion. On 4/20/21 there were 18 preschool children present with one staff and on 4/21/21 there were 16 children present with one staff which poses an immediate health and safety risk to persons in care.

    THIS IS AN AMENDED REPORT101161(a) Limitations on Capacity. A licensee shall not operate a child care center beyond the conditions and limitations specified on the license. This requirement was not met as evidenced by; Based on record reviews and Staff interviews, on more than one day during . the months of April, May and June including during the visit on 6/9/21, approximately 1-4 infants have been placed in the 2 year old classroom which is part of the preschool license which poses an immediate health&safety risk to persons in care.
