What the inspector wrote

Licensing Program Analyst (LPA) Lilia Hernandez conducted an unannounced case management inspection due to a self-reported incident that occurred at the facility. LPA arrived at the facility at 1:20PM and met with Jennifer Movsessian, Principal, who guided LPA on a tour of the facility. There were 27 children in care and 20 staff present upon arrival. The incident that occurred on 10/29/2024, was reported to the Department on 10/30/2024, via email. The facility reported the Unusual Incident to the Department within the required 24 hours of occurrence. Information reported to the Department indicated that on 10/29/2024, student restrooms stopped working. One adult restroom was available for use, students were using elementary school restrooms, and portable restrooms were delivered for use until the Office of Environmental Health and Safety (OEHS), a department with in the Los Angeles Unified School District (LAUSD), cleared the restrooms for use. During today's inspection of the facility, LPA observed restrooms to be operable but inaccessible due to drains located in the restrooms identified as Tots, Girls, and Boys, that had water flowing back up from the drains. The Tots restroom has 3 toilets and 2 sinks that were inaccessible. The Girls restroom has 2 toilets and 2 sinks that were inaccessible. The Boys restroom had 1 toilet, 2 urinals, and 2 sinks that were inaccessible. Per LAUSD policy, the Principal did not have the authority to close the facility during repairs. Closure of the facility is only at the discretion of the Superintendent. Regulation 101239 (h) states based on the total licensed capacity, one toilet and one handwashing fixture shall be maintained for every 15 children. The facility is licensed for a capacity of 115 children. The facility had 2 portable toilets and 2 portable sinks accessible outdoors for children to use. The portable toilets and portable sinks were located on the property of the elementary school next to the fence that separates the licensed facility from the elementary school. ---Page 1 of 3 Regulation 10239(i) states there shall be one toilet and one handwashing fixture, separate from and in addition to the number of toilets and handwashing fixtures required in (h) above, designated for use by children who are ill, for use by staff. Per Principal, the staff restroom located in the staff lounge was the only restroom available for both adults and children to use inside the facility. LPA observed an additional portable toilet and portable sink located in the staff parking lot. Per Principal, the portable toilet and sink located in the staff parking was for adult use only. Principal also disclosed that the portable toilets and sink have been services daily. LPA observed the portable toilets and sinks being cleaned and services during the inspection. Principal disclosed that the preschool restrooms located on the grounds of the adjacent elementary school were also being used. LPA measured the preschool restrooms and found restrooms to be inaccessible by a locked gate and located 177 feet away from the facility. Upon record review, LPA discovered that the preschool is a separate licensed facility. During an interview with staff, disclosures were made regarding Child #1 who soiled there clothes due to the restrooms being inaccessible. LPA conducted an interview with Child #1's parent and parent clarified that Child#1 did not soil their clothes due to restrooms being inaccessible. Child #1 has had previous incidences of soiled clothing both at home and in care. Parent and staff had been working on supporting Child#1 prior to the incident reported. Based on disclosures made by the Principal and observations made by the LPA, the following deficiencies listed on the attached LIC 809D are being cited in accordance with California Code of Regulations Title 22. A copy of this report shall be provided to the parent/guardian of children currently enrolled by the next business day or immediately upon return. A copy of this report shall also be provided to the parent/guardian of any newly enrolled children for the next 12 months (1 year). The Acknowledgement form must be maintained in each child’s file immediately upon receipt from parent. A copy of the LIC 9224 - Acknowledgement of Receipt of Licensing Reports was provided during this visit. ---Page 2 of 3 The Notice of Site Visit was given and must remain posted for 30 days during the hours of operation after each site visit by a licensing representative.
