What the inspector wrote

Licensing Program Analyst (LPA) Lilia Hernandez conducted a Plan of Correction (POC) inspection on 05/23/2025. The purpose of the visit was to ensure that the health, safety, personal rights, licensing conditions and limitations are as required by Title 22 Regulations. LPA arrived at the facility at 9:00AM and met with Carmen Canton, Licensee, who guided LPA on a tour of the facility. LPA observed 1 infant and 1 preschool age child in care upon arrival. Assistant and Licensee\342\200\231s mother were also present. Capacity as specified on the license is being maintained. All adults who reside or work in the home have a criminal record clearance or exemption. There are no excluded individuals present at this home. On 04/10/2025, during the Required 3- Year Annual Inspection, Licensee was issued deficiencies for pool safety. On 04/10/2025, LPA observed an in-ground swimming pool that was inaccessible with a 60 inch fence that surrounds the swimming pool and with some areas of the fence with more than 4 inches from the ground (photo taken). LPA observed vertical rails to the fence with openings larger than 4 inches (photo taken). LPA observed an access gate that opened away from the swimming pool but gate did not self-close or self-latched. LPA observed a second access gate that opened towards the swimming pool with a gate that self-closed and self-latched (photo taken) LPA also observed an iron table that served as a foothold that could enable a child to climb over (photo taken). Per Licensee, there was no second safety device for the in-ground pool, there was no life ring with a minimum exterior diameter of 17 inches and labeled as approved by the United States Coast Guard, there was no rescue pole with a body hook and minimum fixed length of 12 feet and Licensee did not have a daily inspection log available for LPA to review. ---Page 1 of 2 During today's inspection, LPA observed the in-ground pool to have a new fence with one self closing and self latching gate installed.(photo taken). The in-ground pool fence was observed with maximum vertical clearance at the bottom of the self closing gate to be less than 2 inches from the ground(photo taken). LPA also observed gaps between the stationary poles of the fence to be less than 4 inches (photos taken). LPA did not observe any footholds that could enable a child to climb over the pool fence. (photo taken) LPA observed a second safety device for the in-ground pool. LPA observed an alarm system installed in the home that monitors the alarm floating in the pool. Licensee tested the alarm system. LPA was able to verify that the alarm was operable.(photo taken) Per Licensee, an alert also sounds to the Licensee's Apple Watch when there is unusual movement in the swimming pool. LPA observed a life ring with a minimum exterior diameter of 17 inches and labeled as approved by the United States Coast Guard.(photo taken) LPA observed a rescue pole with a body hook and minimum fixed length of 12 feet.(photo taken) Licensee was able to show proof of daily inspection log of the pool conducted in the AM prior to children arrival to care. LPA advised Licensee that in addition to the gate listed on the checklist created, to add all safety features and safety equipment on her list to ensure that all safety features and safety equipment are account for during the inspection before opening the facility. There were no deficiencies cited during today's inspection. The Notice of Site Visit must remain posted for 30 days during the hours of operation after each site visit by a licensing representative. Failure to maintain posting as required will result in a civil penalty of $100.00. Exit interview was conducted with Carmen Canton, Licensee. ---Page 2 of 2
