Inspector’s narrative

What the inspector wrote

Licensing Program Analyst (LPA) R. Derraco conducted an unannounced annual inspection to the above facility on 06/30/25. LPA arrived at the facility at 12:30 PM and met with licensee, Evelia Garcia, who guided analyst on a tour. Also present during this inspection were assistants S2 and S3. Per Licensee, there are 9 children that are currently enrolled. There were 6 children present upon arrival. Per licensee, 3 of her grandchildren (minors) were currently visiting the home during inspection. Licensee was observed to be in compliance with capacity requirements stated on the large family childcare license. This is a one story home which consists of 2 bedrooms, 1 bathrooms, kitchen, dining room, living room, a detached unit, front yard and backyard (fenced). An in ground pool was observed in the backyard area. The pool was observed to be enclosed with a metal fence measuring 60 inches high. LPA observed the space from the ground to the bottom of the fence to be two inches. The space between bars was measured by LPA to be 4 inches. The gate to the pool was observed to open away from the pool. A lock and key are required to unlock the gate and enter the pool. LPA observed that the gate does not fully close on it own. Per licensee, she is aware that the spring on the gate needs to be repaired or replaced. LPA advised licensee that a citation under Health and Safety Code (HSC) Section 1596.814(a)(1)(A)(i) will be issued. The off limit areas include 1 bedroom and front yard. The main care area is located in the living room. LPA observed 2 couches, a wall mounted television and a wooden baby crib. A wall heater was observed in the living room with a cover that is mounted to the wall. Per licensee, isolation area for children showing signs of illness will be located in the living room while they await parent pick up. The bedroom designated for children in care was observed with a bed, bedroom furniture, and two baby cribs. The dining area was observed with a dining table and chairs. The kitchen was observed to have child u-locks on the cabinets below the counter and beneath the sink. Sharp and pointy objects were observed to be inaccessible in a cabinet above the kitchen counter. The licensee states that she provides food for children in care. Licensee was reminded that children whom bring food from home must have their containers individually labelled and properly stored or refrigerated. The laundry area was observed with laundry appliances. LPA observed a cabinet above the washing machine to have cleaning supplies. The bathroom was observed to have an operable sink, faucet and toilet. A detached unit is located in the backyard. Per licensee, children enter through the front door, and walk through the kitchen to the detached unit. The detached unit is designated for an activity space. LPA observed age appropriate toys, art supplies, children reading material, a wall mounted television and an air conditioning unit. Licensee understands that naps and meals must be taken in the main home, and cannot be taken in detached unit designated as an activity space. The outdoor play area was observed with perimeter fencing, shade and children's outdoor play equipment. Four pet dogs were observed in the backyard area. Per licensee, when children use the outdoor play area, the pet dogs are moved to the side of the home. LPA did not observe the following items during the inspection: Infant Walkers, Johnny Jumpers, Saucer Chairs. Emergency Disaster Plan, Parent\342\200\231s Rights Poster and the Facility License were observed to be posted on the wall at the entrance of the home Individuals who reside in the home were noted and discussed. Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated. All areas identified on the facility sketch that are accessible for children to use were inspected for safety, comfort, and cleanliness. There is telephone service via a cellphone that is used and the cellphone stays at the facility during operation hours. LPA observed window mounted air conditioning unit in the dining area. The licensee understands that storage areas for poisons must be locked, not just made inaccessible. The valve on the required 2A 10BC fire extinguisher indicates fully charged and was purchased on 09/17/24, as indicated on receipt. Smoke and carbon monoxide detectors were tested and are operable. Licensee states that there are no firearms stored in the home. Smoking is prohibited in a licensed Family Child Care Home. Per Licensee, no one smokes in the home. The licensee and other personnel have completed training on preventive health practices including Pediatric First Aid and CPR. The licensee's Pediatric First Aid and CPR expires in July 2026. LPA observed that the Licensee and assistant do not have proof of the Mandated Reporter AB 1207 compliant Child Care Training Certificate on file. LPA advised licensee that a citation under HSC section 1596.8662(b)(1) will be issued. File review was observed to have proper mandated immunization records. Children\342\200\231s records were reviewed, including emergency information. LPA observed that C1 and C3 did not have immunization records on file. LPA advised licensee that a citation under California Code of Regulation (CCR) section 102418(g) will be issued. A current children\342\200\231s roster was available for review. LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02- CCP. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. Licensee was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California. During the exit interview, the licensee, confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO profile in FAS. LPA advised the licensee to access forms, regulations and quarterly updates online at: www.cdss.ca.gov . The following deficiencies listed on the attached LIC 809 (deficiency page) are being cited in accordance with California Code of Regulations Title 22. Deficiencies that are being cited need to be cleared to protect the children\342\200\231s health & safety.
