What the inspector wrote

Licensing Program Analyst (LPA) Laticia Thompson conducted an announced case management licensee-initiated inspection for the purpose of a capacity increase. The applicant is requesting an increase to their school-age license from 140 to 200 children ages 4.9 \342\200\223 12 years old. The following rooms will be added to the school age program; #24, #34, #38, #46, Cafe West, Library and Parent Resource Center. The hours of operation are Monday, Wednesday, Thursday and Friday 2pm-6pm and Thursdays 1pm-6pm. There are approved fire clearances conducted on 12/02/2022 for room #34, #27 and #42 and on11/06/2023 for rooms #24, #34, #38, #46, Cafe West, Library and Parent Resource Center. This is an after school program that operates on Carpenter Community Charter Campus. LPA met with Juan Serrano (Assistant Director) and Yolanda Davis (Cluster Leader), who assisted LPA with touring the facility. Upon arrival there were no children present. Indoor Activity Space measurements : Under Title 22 Regulation 101538.3(c) Indoor Activity Space for School-Age Children and Health and Safety Code Section 1596.806(a)(1) a measurement of the facility is not required. Regulation 101538.3(c) School-age childcare programs that meet the requirements of Health and Safety Code Section 1596.806 are exempt from square-footage requirements for indoor activity space: Page 1 of 7 Health and Safety Code Sections 1596.806(a)(1) : (a) A room used as a classroom by a school-age child care program shall not be required to meet the square footage or toilet requirements for child day care centers if the program is operated on (1) A functioning school site in the same facilities that have housed school children during the day, before or after school hours, or before and after school hours. Outdoor Play measurements : Under Title 22 Regulation 101538.2(c)(1) Outdoor Activity Space for School-Age Children and Health and Safety Code Section 1596.806(b)(1) a measurement of the outdoor activity space is not required. Regulation 101538.2(c)(1): (c) School-age child care programs that meet the requirements of Health and Safety Code Section 1596.806 are exempt from square-footage requirements for outdoor activity space, (1) Health and Safety Code Sections 1596.806(b), (b)(1) and (d) pertain to the exemption from square-footage requirements for outdoor activity space for school-age child care programs that meet the requirements of Health and Safety Code Section 1596.806. Health and Safety Code Section 1596.806(b)(1): (b) School grounds, other than rooms used as classrooms, used by a school-age child care program operated on a functioning school site pursuant to either paragraph (1) or (2) of subdivision (a) shall be exempt from all of the following requirements imposed by the department on child day care facilities: (1) Fencing, outdoor activity space, toilet, and isolation space requirements... LPA Thompson toured the on-limits areas and classrooms located in the facility. Children will have access to 8 sinks and 10 toilets 6 Urinals. Page 2 of 7 The following was observed. Restrooms are located on the first floor of the two story leveled classrooms. There is a waiver on file for restroom usage. Director stated children will not use restroom located in parents conference room. Sign-In and Sign-Out sheet are located outside of room #42, The facility provides filtered drinking water that is readily available in each class and on the playground areas. There is one carbon monoxide detectors located in classroom #42. Facility will install detectors in all classrooms or provide proof of a carbon monoxide monitoring system. LPA observed a First aid kit with the required materials including a handheld digital thermometer. Furniture and equipment were observed to be maintained in good condition, free of sharp, Loose or pointed parts. Tables and chairs were observed to meet the needs of the children. All play equipment and materials used by children were observed to be age-appropriate. There are hanging hooks, portable storage containers and the use of children backpacks as storage space for their clothing and personal belongings. Outdoor playground equipment is in safe condition, free of sharp, loose or pointed parts. The surface of the outdoor activity space is maintained in a safe condition and is free of hazards. There is adequate shade in the outdoor activity area. LPA observed shade and benches for resting. Page 3 of 7 The school has heating and cooling systems. The classrooms were clean in good repair. Windows were in good repair free of chipping paint, dirt, insects or debris. Adequate lighting was observed The facility is equipped with landline telephones service located in classroom #42 Medication is stored in a locked safety box located in classroom #42. Facility has an additional locked storage box to store medication that may need refrigeration. The required postings are posted in a common area for parents and visitors review. Room#42 will be used as an ill/isolation area. Ill children will use the restroom located across the playground area next to room #46. There is also a foam mat available for children to rest if needed. LPA observed fire extinguishers in all classrooms with current inspection dates. The program provides evening snacks. LPA observed a posting of the monthly menu. The facility has an Incidental Medical Service plan in the event that services are needed. LPA observed trash cans having tight fitting lids. LPA did not observe any bodies of water on the premises. Page 4 of 7 LPA observed disinfectants, cleaning solutions, and other items that are dangerous to children, under the sinks accessible to children. The items were observed in classrooms #14, #46, #24 and the Parents conference room. The assistant director will install safety latches to prevent access. Director will insure that children will be supervised at all times preventing children from accessing doors into joining rooms. Room #38 has a door that connects to room #37. Room#46 has a door that connects to Room#46A. Room#24 has a doors that connects to room#25 and #23. The following items were discussed: Assistant Director was reminded that all adults 18 and over responsible for administration or direct supervision of staff, persons who provides care and supervision to children, and staff who have contact with children, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated. LPA reviewed with facility representative the LIC 311A, Records To Be Maintained At The Facility, for child\342\200\231s records, personnel records, administrative records, and documents to be posted. Page 5 of 7 Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010, to test their water (used for drinking and food preparation) for lead contamination before January 1, 2023, and then every 5-years after the date of the first test. For child care center licenses issued after July 1, 2022, the licensee shall test their water for lead within 180 days of licensure pursuant to Written Directives section 101700 (PIN 21-21.1-CCP). LPA verified that the lead testing was completed in accordance to the Written Directives outlined in PIN 21-21.1-CCP . Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02-CCP . When any IMS is provided, an updated Plan of Operation that includes IMS must be submitted to the Department. Community Care Licensing Division (CCLD) regularly sends information to licensed facilities, providers, and stakeholders by way of Provider Information Notices (PIN), Program Quarterly Update Newsletters and other important information communication platforms. Page 6 of 7 The following corrections are needed before an increase of capacity licensure will be considered. Corrections are due by 12/12/2023 \302\267 Place safety latches on cabinets where needed. \302\267 Provide proof of carbon monoxide monitor or install carbon monoxide detectors in all classrooms An exit interview was conducted with the above items discussed and a copy of appeal rights and this report was provided to Juan Serrano (Assistant Director). Final license determination will be made upon review by the Licensing Program Manager and correction of the above issues. Page 7 of 7
