What the inspector wrote

Licensing Program Analysts (LPAs) Lilia Hernandez and Roberto Luque Avila met with applicant Estela Rodriguez on 07/16/2024. The purpose of the visit was a 2nd announced pre-licensing inspection at the home to ensure that health, safety and personal rights as required by Title 22 and Health and Safety Regulations governing California Child Care Homes will be met. No children observed at visit. On 06/26/2024 LPA conducted the 1st pre-licensing visit. Applicant was advised that the in-ground pool located in the backyard shall be made inaccessible to children and the fence shall meet regulations. During the visit pool fencing was observed to not meet regulations. Pool regulations are as follows: per Child Care Regulation 102417(g)(5) Operation of A Family Child Care Home (5) All licensees shall ensure the inaccessibility of pools (in-ground and above-ground), fixed-in-place wading pools, hot tubs, spas, fish ponds and similar bodies of water through a pool cover or by surrounding the pool with a fence. Per Child Care Regulation 102417(g)(5)(A) Operation of A Family Child Care Home (A) Fences shall be at least five feet high and shall be constructed so that the fence does not obscure the pool from view. The bottom and sides of the fence shall comply with Division 1, Appendix Chapter 4 of the 1994 Uniform Building Code. In addition to meeting all of the aforementioned requirements for fences, gates shall swing away from the pool, self-close and have a self-latching device located no more than six inches from the top of the gate. During today\342\200\231s inspection, LPAs observed the pool fencing to be in good repair and completely surrounding the pool. LPAs observed fence to be made of black wrought iron between the pool and the home. The black wrought iron fencing was observed to have vertical rails with less than 4 inches of space between the rails. ---Page 1 of 2 Fence is designed and installed so that children could not remove any portion of the fence. A portion of the fence measure 5 feet in height. The fencing where the gate is attached measured 6 feet, 2 inches in height. Bottom of the fence measured 2 inches from the ground made of cement. The portion of the fence that is location above a soft surface, grass, is 9 inches from the ground. However, the 9 inch space is blocked by retaining wall for the grass with less than the 2 inch space thst make the pool inaccessible. The pool gate swings away from the pool that self- closes and self-latches. The self-latching device is located no more than 6 inches from the top of the gate. The pool fence does not obscure the pool from view. The rest of the fencing is made of wooden slates and chain link fence with privacy slats inserts along the exterior of the property that also makes the pool inaccessible to children. There was a detached garage used for storage with a door that was secured with a chain door guard located 6 feet from the ground making the garage inaccessible to children. On 07/09/2024, Fire Inspector Theodore Debs submitted an amended STD850 indicating that the pool fencing and gate was inspected and an approved. Pictures of the pool area and pool fencing with measurements were taken during visit. As a best practice, LPAs suggested the applicant take a water safety course. A large family child care license may be granted upon final determination by the Licensing Program Manager. Once licensed, the applicant is required to adhere to the terms and limitations stated on the license. A copy of this report and all other Licensing reports must be made available to the public for 3 years.
