LPA reviewed the pictures and videos and observed 17 children in the backyard of the facility. Children were seen holding presents, and dancing. Another photo showed children lined up in the backyard. Per Licensee, the facility occasionally holds “open house” events during which families interested in the day-care are invited to tour the facility and allow their children to interact with the enrolled day-care children. The Licensee stated that an open house was held in December, which is why additional children were present that day. The Licensee stated that all parents remained on site and did not leave their children in care. The Licensee stated that these events are advertised on Facebook or Instagram, where parents call or message them to sign up to attend. The Licensee further stated that they have never had more than 14 children in care at one time. Per Licensee, her daughter-in-law manages all communication with interested families and coordinates the tour dates. LPA spoke with the Licensee’s daughter-in-law and requested documentation demonstrating that an open house had been scheduled. LPA requested screenshots of any Facebook or Instagram posts, text message communication, or any other documentation showing that an open house had occurred. The Licensee’s daughter-in-law was unable to provide any documentation to the LPA. Per staff interviewed, staff reported they were not employed during the month of December and were unable to confirm whether the facility held an open house for parents. Children were not interviewed as the allegation was not pertinent to the children in care. During both visits to the facility, the LPA did not observe the facility to be over capacity. Based on the investigation conducted, there is insufficient evidence to support the above-mentioned allegations to be true. Therefore, although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are Unsubstantiated. The Notice of Site Visit was provided and must remain posted for 30 days during the hours of operation after each site visit by a licensing representative. Failure to maintain posting as required will result in a civil penalty of $100.00. Exit interview was conducted with Licensee's assistant and Alla Skrypnyk and Appeals Rights provided. Page 2.
