What the inspector wrote

Based on LPAs observation and interviews, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. California Code of Regulation, (Title 22 Division 12 and CCR 101161 (a), is being cited on the attached LIC 9099 D). A closing interview was conducted with Administrator. Administrator was provided and advised of their right to appeal. A copy of this report was reviewed and provided to the Administrator. The Notice of Site Visit was also provided to the Administrator as required by H&S Code Section 1596.817. The Notice of Site Visit must remain posted for 30 days or a civil penalty of $100.00 may apply. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is UNSUBSTANTIATED. The Notice of Site Visit was also provided to the Licensee as required by H&S Code Section 1596.817. The Notice of Site Visit must remain posted for 30 days or a civil penalty of $100.00 may apply.

    (a) A licensee shall not operate a child care center beyond the conditions and limitations specified on the license, including the capacity limitation.This requirement was not met as evidenced by the following: CCC failed to adhere to the terms of a 10/31/22 waiver issued by CCLD for the staggered use of an outdoor play area in that CCC exceed capacity of four children in the area. This poses at potential risk to the health, safety and personal rights of persons in care.

This requirement was not met as evidenced by the following: Records review revealed S1,S2,S3,S4 and S5 failed to have current Immunization (T-Dap, MMR, Influ.). This poses at potential risk to the health, safety and personal rights of persons in care.
