the known biters from having access to the other children. LPA observed staff maintaining supervision over the children in the classroom and the outside play area. LPA observed video footage of staff maintaining supervision and distracting biters to prevent biting incidents. Although the allegations may have happened or is valid, there is not a preponderance of evidence to prove the above alleged violation did or did not occur, therefore the allegation of Care & Supervision is found to be unsubstantiated. Based on documentation received and video footage reviewed, there was no Care and Supervision violations. The facility has an active safety plan in place to prevent biting incidents. Staff maintain supervision throughout the facility. Staff communicate with parents when incidents occur, document the incident on an app and discuss action plans with parents. Exit interview was conducted with Ana Bernshteyn, Director. Appeal Rights were provided.
