What the inspector wrote

On 03/11/2026 , Licensing Program Analyst (LPA) Cristina Castellanos conducted an unannounced 3-Year Required Inspection at the above-referenced Family Child Care Home. LPA was greeted by staff member S3, who granted LPA entry. Shortly after at approximately 9:10am Licensee Sandra Diaz Martinez arrived at the home. Present during today\342\200\231s inspection were Licensee Diaz-Martinez, Licensee\342\200\231s adult son, Licensee\342\200\231s small pet dog, two (2) staff members (S2 & S3), and five (5) children in care. The purpose of this inspection is to ensure that the licensee continues to meet the health, safety, and personal rights requirements outlined in Title 22 Regulations governing California Family Child Care Homes. The facility is licensed as a Large Family Child Care Home with a maximum capacity of 14 children. The program currently accepts infants from 3 weeks of age through 12 years old. The facility operates from 4:30 a.m. to 4:30p.m., Monday through Friday, and the licensee currently does not provide overnight or weekend care. Capacity as specified on the license is being maintained during today\342\200\231s inspection. The single-family home consists of a living room, a dining area, 3 bedrooms, 1 bathroom, a kitchen, a laundry area, and a detached garage. Note: The detached garage has a converted space with a bathroom. Licensee confirmed the following areas are OFF LIMITS to the children in care: bedrooms 1 & 2, the laundry area, the detached garage. The laundry area is used as a walkway to the children\342\200\231s designated bathroom inside the home. Continue Licensee confirm the home has one (1) small dog pet and registered families are notified. The pet dog is kept away from the children during the hours of operation. LPA reminded licensee that any area designated as OFF LIMITS should be made inaccessible during the hours of operation and/or while children are present. LPA provided Licensee a copy of the CAL FIRE - Office of the State Fire Marshal Information Bulletin 20-008 Issued: March 19, 2021 , for her review. Families enter the home through the side gated entrance and proceed directly to the converted garage space. According to the Licensee, the living room and the converted garage space with an adjacent bathroom serve as the designated day care areas. The fireplace in the living room and the open-faced heater in the converted garage were observed to be properly barricaded. Adequate heating and ventilation were present throughout the licensed areas to ensure children\342\200\231s safety and comfort. Age-appropriate toys and play equipment were available and in good condition. The home maintains a working telephone service. Licensee confirmed that she provides meals and snacks to the children. LPA discussed the importance of maintaining clear policies to ensure that all individuals assisting with care and supervision are aware of any dietary restrictions or allergies. No firearms or ammunition are stored on the premises. Detergents and cleaning compounds are stored under the kitchen sink in a cabinet secured with a magnetic lock. Additional cleaning supplies are stored on a high shelf in the laundry area, out of children\342\200\231s reach. LPA observed a working fire extinguisher in Bedroom 3, located near the kitchen and outdoor area. A functioning dual smoke and carbon monoxide detector was observed in both the living room and the converted garage space. The Licensee is reminded that fire and disaster drills must be conducted at least once every six months. Each drill must be documented with the date and time, and this documentation must be kept on site at the family child care home. Page 2 The licensee confirmed that the home is prepared to accept a child who may require medication; however, no children currently in care require medication. The licensee ensures that children are supervised at all times and understands that children must never be left in parked vehicles. Car seats are used solely for transportation and not for sleeping. The \342\200\234Prohibited Items in Family Child Care Homes\342\200\235 flyer was provided. Safe Sleep regulations were reviewed due to the program\342\200\231s availability for infant care. There is one crib or play yard available for each infant in care. All cribs and play yards are kept free of loose articles and objects while infants are sleeping, and no items are hung above or attached to them. Infants are not swaddled while in care. The provider conducts physical checks on sleeping infants every fifteen minutes and documents any signs of distress, including but not limited to flushed skin, increased body temperature, restlessness, or labored breathing. Infants sleeping in a separate room remain within visual observation through an open door. Infants up to 12 months of age are placed on their backs for sleeping. The Individual Infant Sleeping Plan was discussed, and the LIC 9227 form was reviewed. LPA reviewed three (3) personnel files and confirmed that all staff are in compliance with current Pediatric CPR/First Aid and Mandated Reporter Training requirements. LPA reminded the licensee of the importance of ensuring that all vendors providing Pediatric CPR and Pediatric First Aid training are approved by EMSA. LPA then reviewed five (5) children\342\200\231s files and observed that all files were complete. LPA provided the licensee with updated copies of the LIC 311D and LIC 126 to use as references when conducting future file audits. Family Child Care Home Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated. Page 3 LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-andresources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02- CCP. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. Licensee was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California. Per Title 22, Division 12, Chapter 3, of the California Code of Regulations, there were no deficiencies cited at this time. An exit interview was conducted and reviewed with Licensee Diaz-Martinez. A copy of this report was discussed and left with Licensee. A Notice of Site Visit was given and must remain posted for 30 days. Failure to comply with the posting requirements shall result in an immediate civil penalty of $100. Page 4
