What the inspector wrote

THIS INSPECTION WAS CONDUCTED IN ENGLISH AND IN SPANISH On 09/29/2025 at 09:15 AM, Licensing Program Analyst (LPA) Elicia Calvillo and Licensing Program Manager (LPM) Rita Ramos conducted an unannounced Case Management -Deficiencies visit. LPA and LPM identified themselves and initially met with Catherine Arriaga, Assistant who guided analyst and LPM on a tour of the inside and outside of the facility. LPM and LPA observed 15 children in care and there were 5 children under the age of 2 years and 10 under the age of 5 years. The facility was not operating as specified in section 102417(g)(8). This poses an immediate health, safety or personal rights risk to persons in care. LPM and LPA asked Catherine Arriaga where were both Licensees. Per Catherine Arriaga, Catalina Arriaga, Licensee was in the off limits area and was called out to the day care area. Catalina Arriaga came out of the off-limits area and asked LPM why LPM and LPA were at the facility. LPM spoke to Licensee in Spanish due to Licensee Catalina asking if LPM knew Spanish. LPM spoke to Licensee Catalina and informed Catalina that LPM and LPA are present due to a complaint but LPM and LPA observed that Licensee is overcapacity. LPM asked if co-licensee , Antonio is present. Per Catalina, Antionio Arriaga, is rarely at the facility and is not present due to doing "personal things." LPM asked why Licensee Antonio is rarely present and LPM asked where Antonio is. Catalina asked LPM if LPM needs to know "personal things." LPM asked Catalina if Antonio is a co-licensee, then the question is where is he if children are in care. Licensee Catalina re-stated that Antonio is doing personal things and started telling LPM to relax. LPM told Page 1 of 3 Licensee Catalina, that LPM is relaxed but if Licensee is raising their voice then Licensee may need to relax. LPM and LPA observed that children were crying and LPM informed Licensee Catalina that they can assist their daughter and Staff #2 with the 15 children in care. LPM turned to point out that Licensee's daughter needed assistance and Licensee Catalina stated, "She's fine." LPM asked Licensee to repeat and Licensee stated, "Why are you ignoring me." LPM stepped back and Licensee Catalina stated something and stepped forward. LPM stepped back. Licensee Catalina tapped LPM's arm and Licensee Catalina kept stepping forward and pointed at LPM. Licensee kept stating why are you here? LPM repeated why LPM and LPA were at the facility and LPM kept stepping back as Licensee kept stepping forward and pointing at LPM. Licensee stated that LPM is ignoring LPM. LPM asked Licensee to please stop pointing at LPMs face and stepping forward. LPM informed Licensee Catalina that LPMs concern is the 15 children in care with 5 infants and 10 children under the age of 5 years which is overcapacity. Licensee raised their voice and informed LPM that LPM was being too aggressive and in a raised voice asked LPM, "How much distance do you want!?" LPM stepped back and put their hands behind their back and Licensee Catalina kept stating how much distance do you want!?" LPM informed Licensee Catalina that their focus should be on assisting their daughter and Staff #2 with the 15 children in care and the infants that were crying. Licensee turned to look at Staff #2 and told Staff #2, "Look, you are my witness, she is ignoring me." Licensee's daughter turned to Staff #2 and informed Staff #2 just keep doing your job. LPM informed Licensee Catalina, that even their daughter is directing Staff #2 to take care of the children. Licensee stated that their daughter and Staff #2 are fine and they will be going inside of the home (off-limits area) to cook for the children. At approximately 10:05AM, Licensee Catalina came back to the child care area and placed their hands behind their back and paced back and forth in front of LPM and informed LPM, "I'm keeping my distance. See, look at me, I'm keeping my distance." Licensee then asked LPM for "Rita's" telephone number. LPM informed Licensee that LPM is Rita. Due to LPM writing notes on their clip board. Licensee Catalina took out a piece of paper and stated that they can also write their notes. LPA and LPM observed in the outdoor play area hazard that pose a danger to children in care. There buckets of water around the outdoor play area that were easily reachable to children, the back door was opened that leads to the off limit areas, there were cleaning products by the back door, and propane tanks store near the back door (photos taken).The facility was not operating as specified in section 102417(g). This poses an immediate health, safety or personal rights risk to persons in care. Page 2 of 3 Based on observations by the LPA and LPM, Assistant disclosures, and record review the deficiencies listed on the attached LIC 809D page are being cited. LPAs informed the Assistant that Type A citation(s) shall be posted for 30 consecutive days as there are immediate risk(s) to the health, safety, or personal rights of children in care. LPA Calvillo informed facility representative Catalina Arriaga that this report dated 09/29/2025 documents one Type A citation which shall be posted for 30 consecutive days as there is an immediate risk to the health, safety, or personal rights of children in care Also, LPA Calvillo informed the facility representative to provide a copy of this licensing report dated 08/22/2025 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. The Notice of Site Visit must remain posted for 30 days during the hours of operation after each site visit by a licensing representative. Failure to maintain posting as required will result in a civil penalty of $100.00. Exit interview was conducted with Catalina Arriaga, Licensee including, but not limited to Provider Rights, Appeal Procedures and Agencies Consultative Role. Page 3 of 3
