What the inspector wrote

On September 7, 2022, Licensing Program Analysts (LPAs) Isabel Ortega and Barbara Beneroso conducted a Case Management inspection in response to information received from the State Water Resources Control Board (SWRCB), Division of Drinking Water (DDW). LPA Ortega and Beneroso met with the Director Rosie Gurrola, the purpose of the inspection was disclosed and entry was granted. Upon arrival LPAs observed 27 children were observed and 5 staff present today. During the inspection, LPAs Ortega and Beneroso informed Director, the results provided from SWRCB, indicated the facility had elevated levels of lead in the water in the outdoor playground drinking fountains (Upper level D and lower level C). The Department was notified of the Action Level Exceedance (ALE), levels are at Drinking fountain D in upper playground presented levels of 20.00 UG/L and drinking fountain C in the lower level playground 5.70 UG/L. The SWRCB report sample listed facility inspected and collected sample on 8/06/2022. Results were provided to facility on 09/2/2022. Lab Job Number: 467147. Director notified LPA Beneroso within the required timeline. LPAs advised Director, all water outlets tested with an ALE at the facility should be placed as out of service and children should be provided with an alternative potable water. LPAs observed a water pitchers in every classroom which is obtained from the kitchen filtered faucet (in compliance) with lead levels. Director advised LPAs Ortega and Beneroso per the sample results, the drinking fountains fountain C in the lower level playground and Drinking fountain D in upper playground had a high level of lead. LPAs Ortega and Beneroso observed that the individual drinking fountains were accessible. According to Director, last day drinking fountains were utilized by children was May 2020 following Covid-19 protocols. The Director stated the drinking fountains C and D will be assessed for repair and replacement on 09/08/2022, appointment confirmed while conducting the inspection. Once the repairs are made, director will retest water for lead and notify LPAs of results after 3 weeks. Director is aware the lead levels shall not exceed 5.00 UG/L Per director, the entire fixture will be replaced and re-tested. See LIC 809D for cited deficiencies in accordance with the California Code Regulations Title 22, Division 12. LPAs Ortega and Beneroso informed the facility Director although the drinking fountains are not utilized for food preparation nor drinking water, the drinking fountains are still accessible to children. An exit interview was conducted, a copy of this report, appeal rights and a Notice of Site Visit was provided to Director on this day. This report shall be public record for three years. 812 for the case management
