Inspector’s narrative

What the inspector wrote

On 9/15/2022 at 8:30 am Licensing Program Analyst (LPA) Deborah Lowe conducted an unannounced case management visit. LPA Lowe was greeted by director Cherly Gartsman and granted entry into the facility. Director guided LPA Lowe on a tour of the facility. At 9:00 am there were 3 adults and 29 children present during the visit. At 10:16 am LPA Lowe began a 2 nd tour the facility to obtain an updated census due to more children and adults have arrived. LPA Lowe observed 35 children under supervision of 5 adults. At 10:17 am LPA Lowe observed adult #1 (A1) in the Early Preschool classroom supervising 9 children. A1 was observed to be the only adult in the room. At 10:22 am LPA Lowe observed adult #2 (A2) in the STEAM room supervising 7 children. A2 was observed to be the only adult in the room. On 9/15/2022 LPA observed Director meet with both adults and sent the 2 adults home. Adults were advised a criminal clearance will be needed before return to facility. This observation will result in a Type A Citation with a Civil Penalty of $600. LPA advised this Type A citation will include a civil penalty of $500, $100 for each day the employee was present without a clearance. Allowing any person who is subject to a background check to work, reside or volunteer who does not have either a criminal record clearance or exemption . A civil penalty shall be assessed for a maximum of 5 days for the first violation. For subsequent violations within a 12 month period, a civil penalty shall be assessed for a maximum of 30 days. See California Health and Safety Code Section 1522(c)(1); 1568.09(c); 1569.17(c); and 1596.871(c). Per Title 22, Division 12, Chapter 3, of the California Code of Regulations, the following deficiency is being cited: (see next page, 809 D) LPA Lowe informed facility representative Cherly Gartsman that this report dated 9/15/2022 documents 1 Type A citation which shall be posted for 30 consecutive days as there is immediate risk to the health, safety, or personal rights of children in care. LPA Lowe informed the licensee to provide a copy of this licensing report dated 9/15/2022 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. Licensee was provided a copy of their appeal rights. A notice of site visit was given and must remain posted for 30 days. Exit interview conducted, appeal rights were explained, and report was reviewed with the facility representative Cherly Gartsman .

This requirement is not met as evidenced by: Based on observations, interviews, and review of Guardian the facility did not ensure background clearance was obtained for 2 adults who were in care and supervison of children which poses an immediate health, safety or personal rights risk to persons in care.

    101700.3(b)(1), A result with values of 5.5 ppb or greater shall be deemed an Action Level ExceedanceThis requirement is not met as evidenced by:Based on observation, interviews, and review of Lead water testing samples taken on 8/23/2022 revealed that levels of lead were beyond allowable amount deemed by the State of California. 3 Handwashing sinks have lead exceedance levels of sample "D" is 6.01 ppb, sample "I" is 5.90 ppb, and sample "J" is 16.0 ppb. This poses a potential health and safety risk to children in care.
