What the inspector wrote

On 08/03/23 at 3:49pm, Licensing Program Analyst (LPA) Lilia Hernandez conducted an unannounced site visit for the purpose of conducting a Case Management-Deficiencies visit to cite for a deficiency discovered by LPA Antonio Almanza on 05/31/23 during a site inspection. LPA Hernandez met with Director Cheryl Gartsman and explained the purpose of the visit. During today’s visit, there were 13 staff providing care and supervision to 70 children in care. During the 05/31/23 site inspection, LPA Almanza discovered that Child 1 (C1), whose date of birth is 12/19/17, and who was terminated from the daycare on 05/19/23, was 5 years and 5 months old at the time of termination. Director Gartsman disclosed to LPA during an interview that C1 was 5 years old, meaning she had knowledge of the age of C1. The Child Care Center is licensed to provide services to 120 preschool children ages 2 through 4.9 years old. The facility is in violation of the conditions and limitations specified on the license granted by Community Care Licensing due to the fact that the preschool is providing service to children over 4.9 years of age. California Code of Regulations, Title 22, Division 12, Chapter 1, Article 02, Section 101161 Limitations on Capacity is being cited on the attached 809D. In addition, an immediate civil penalty of $250 is being assessed since this is a repeat violation within 12 months of the same regulation. A notice of site visit was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with the facility representative Cheryl Gartsman.
