Inspector’s narrative

What the inspector wrote

During the interview with the Director, Staff 1 was described as being very loving, kind, caring, protective and understanding. Per the Director, there were no witnesses to the alleged incident. When the Director questioned Staff 1 regarding the alleged incident/allegation, Staff 1 denied hitting Child 1. There were no bruises observed on Child 1. Staff 1 has no prior complaints or disciplinary actions against her. Child 1 is currently enrolled and still attends Tutor Time Learning Center. During the interview with Staff 1, Staff 1 denied ever hitting Child 1 and stated that Staff 1 patted Child 1 in the hip area for doing a good job after using the toilet. The pat was described the same as a teacher would normally do during nap time. The pat in the hip area was a positive gesture/positive reinforcement to the child. There was no bruising sustained to Child 1. Staff 1 disclosed that she would never do anything to cause harm to any of the children. During the interviews with staff, the statements obtained were consistent and corroborated with the statement obtained from the Director. Parents interviewed did not present concerns related to the above-mentioned allegation and were pleased with the services and care being provided to their children. LPA made attempts to interview children (including Child 1) but was unsuccessful due to insufficient information obtained. Based on the investigation conducted, there is insufficient evidence to support the above-mentioned allegation to be true. Therefore, although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is Unsubstantiated. The Notice of Site Visit was provided and must remain posted for 30 days during the hours of operation after each site visit by a licensing representative. Failure to maintain posting as required will result in a civil penalty of $100.00. Exit interview was conducted with Director / Cheryl Gartsman and Appeals Rights provided.
