What the inspector wrote

On 06/29/23 at 8:04 AM, Antonio Almanza, Licensing Program Analyst (LPA),conducted an unannounced Case Management Visit. LPA met with Cheryl Gartsman, Director and explained the purpose of the site visit. During today’s visit there were 8 infant children and 2 adults providing care and supervision to children in care. On 06/15/23 at 8:53 AM, Antonio Almanza, Licensing Program Analysts (LPA), was at the licensed Combination Center (Infant, Preschool, and School-age) conducting an unannounced visit. LPA toured the facility unescorted due to the director Cheryl Gartsman, assisting the infant classrooms as part of the ratio. Infant child ratios are 4 to 1. - At 8:59 AM, the Director came out of Room 1 with 1 infant and took the infant to Room 5. - At 8:59 AM, LPA observed Staff 1 (S1) and Staff (S2) with 8 infants in Room 1. - At 9:13 AM, LPA observed the Director in front of the preschool office with 3 infants in the “Buggy”. - At 9:14 AM, LPA observed 4 infants in Room 5 with Staff 3 (S3). - At 9:29 AM, LPA observed 4 infants in the buggy with the Director, one additional infant arrived increasing the number of infants to 4. - At 9:38 AM, LPA observed the Director and staff 3 in room 5 with 8 infants. - At 9:40 AM, LPA observed S1 and S2 with 10 Infants. According to the Face-to-Name, at 8:43 AM 2 infants arrived putting room 1 out of ratio, 10 infants to 2 staff. - At 9:43 AM, LPA observed Staff 3, Staff 4, and Director with 8 infants in room 5. - At 9:54 AM, Director went into Room 1 to assist as there were 10 infants and 2 staff, complying with the ratios required. - At 10:52 AM, Staff 5 (S5) arrived at the combination center and Staff 6 (S6) went to room 1 to relieve the Director. - At 10:53 AM, the Director was now available to interact with LPA Almanza as required by regulations. On 06/15/23, according to the Face-to-Name Transition sheet, the Infant classroom 1 was out of ratio from 8:43 AM to 9:54 AM. The Director had to assist in the infant classrooms from 8:59 AM until 10:52 AM because the infant and preschool did not have sufficient teachers to meet minimum ratio requirements and there was no other staff that could provide assistance in the classrooms. During this time the facility continued to accept children and there were no staff at the front desk to direct parents to their children’s classrooms. The combination center did not have any staff available that could relive a teacher from their respective classrooms if for any reason they had to step out. The Director informed LPA Almanza that Staff 5 had called in and would come to work as soon as S5 was available but could not provide an exact time. On 06/15/23 at 9:13 AM, LPA observed the Director with 3 infants inside the Buggy, in front of the Directors office. The director was greeting parents and directing children to their classrooms. At 9:29 AM LPA observed 4 infants in the buggy. At 9:38 AM, LPA observed the Director in room 5 with Staff 12 and 8 infants, Director stated they had been in the room for 5 or 6 minutes. On 06/14/23 t at 7:36 AM, LPA entered the combination center to conduct an unannounced sit visit. Upon arrival, LPA observed Staff 5 and 3 infants sitting in the infant “Buggy” located in the lobby between the Directors office and the front desk. According to the Face to Name sign in sheet, the 3 infants arrived between 6:37 AM and 7:24 AM and were taken into their classroom after LPA arrived. LPA observed staff 5 greeting parents in the lobby and directing them to their children’s classrooms. Staff 5, 11 and 12 are reporting that during drop off, infant children are placed in the buggy located in the lobby. At 8:00 AM, infant children are picked up from the buggy and taken to their classrooms, LPA Almanza discovered that this is a regular occurrence. During todays visit 06/29/23 at 8:04 AM, upon arrival to the facility LPA observed 4 infant children in the Buggy with the Director and Assistant Director. The Director stated that they are allowed to keep infant children for 20 minutes at a time in the buggy. Assistant Director stated that infants had just arrive and had not been long in the buggy. LPA asked for the Face-To-Name transition sheet and Assistant Director stated it was in the classroom and that she had just relived Staff 1 who was supervising infants. Upon reviewing the Face-To-Name, LPA observed that Child 1 arrived at 6:45 AM, Child 2 arrived at 7:40 AM, and Child 3 and 4 arrived at 7:56 AM. LPA Interviewed staff 1 who reported that she was supervising the infant children and that as they arrived they were placed on the buggy. Page 2 of 3 The purpose of he infant “buggy” is to transport infant children in the facility. Infant children are being placed in the buggy to allow staff to supervise infants while conducting other activities in the lobby. Two Type B Violation are being cited, under California code of Regulations, Title 22, Division 12 & Chapter 1, on the attached LIC809D. A notice of site visit was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with the facility representative Cheryl Gartsman. Page 3 of 3.

    Staff-Infant Ratio, There shall be a ratio of one teacher for every four infants in attendance.This requirement is not met as evidenced by: Based on observation, interview, and record review, on 06/15/23 the Infant classroom 1 was out of ratio from 8:43 AM to 9:54 AM, which poses a potential Health or Safety, or personal rights risk to persons in care.

    Limitations on Capacity and Ambulatory Status, It shall be permissible for a child whose developmental needs require continuation in an infant care center to remain in an infant care center up to a maximum age of three years. This requirement is not met as evidenced by: Based on LPA’s observation, interviews conducted, and records reviewed, on 06/14/23, from 07:07-07:33 am, there were five pre-school children, one school-age child and three infants commingled in the lobby. This poses a potential health, safety, or personal rights risk to the children in care.
