What the inspector wrote

During the initial complaint investigation on 07/12/2024, LPA obtained teacher's time sheets and children's sign in and sign out sheets from 07/01/2024 through 07/12/2024. LPA conducted two unannounced inspections. On 07/12/2024 at 8:10 AM, LPA toured the designated infant classrooms (Toddler 1, Toddler 2, Infants) and outdoor play areas and observed there were three toddlers in Toddler 2 room supervised by one staff. At 11:25 AM LPA toured the facility again and observed four infants in Infant room supervised by one staff and nine infants in Toddler 2 room supervised by three staff. On 10/04/2024 at 7:45 AM, LPAs toured the facility and observed four infants in Toddler 2 room supervised by one staff. At 9:10 AM LPAs toured the facility again and observed five infants in Infant room supervised by one staff and 13 infants in Toddler 2 room supervised by four staff. One infant was removed from Infant room immediately and moved to Toddler 2 room. At 9:13 AM LPAs toured the facility again and observed four infants in Infant room supervised by one staff and 14 infants in Toddler 2 room supervised by four staff. At 10:38 LPAs observed six infants in Infant room supervised by two staff and 14 infants playing outside supervised by four staff. When interviewed, staff stated that a proper ratio is always maintained in the classrooms. The director, assistant director, and floater teacher are always available if extra coverage is needed. When interviewed, all parents stated that a proper ratio is maintained in the classrooms. Parents explained that there are cameras in the classrooms where they can watch their children. They noted that the facility is very strict when it comes to ratios. Based on LPAs' observations, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. California code of Regulations, Title 22, Division 12 & Chapter 1, Subchapter 02. In care Centers, 101416.5 Staff-Infant Ratio is being cited on the attached LIC9099D. A notice of site visit was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with the facility representative Cheryl Gartsman. Page 2 of 2 When interviewed, all five staff stated that they have never spoken or seen another staff member speak in an aggressive, irate, or inappropriate manner. When interviewed, all seven parents stated that they have never seen or heard staff members speaking in an aggressive, irate, or inappropriate manner. While the parents mentioned that they can watch their children from the classroom cameras, there is no sound. However, they have not heard any behaviors of this kind during in-person interactions. On 07/12/24 and 10/04/2024, LPA conducted an unannounced site visit. LPA inspected the infant center and observed staff interacting with children. LPA did not observe infants crying and staff spoke to infants in a calm composed tone of voice. LPAs did not observe any interactions of concern. Although the allegation may has happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is unsubstantiated. A notice of site visit was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with Cheryl Gartsman, Director.
