What the inspector wrote

Page 2 Based on the evidence obtained, the preponderance of evidence standard has been met, therefore the above allegation is found to be substantiated. California Code of regulations, (title22) is being cited on the attached LIC 9099D. Appeal rights were provided and exit interview conducted with, facility representative. The Notice of Site Visit was given and must be posted for 30 days.

    (a) The licensee shall ensure that each child is accorded the following personal rights: (3)To be free from corporal or unusual punishment,... including but not limited to: interference with functions of daily living... sleeping or toileting...This requirment is not met as evidence by: Based on interviews, three out of seven interviews consistently stated that a staff woke children up from their nap. This pose a potential health, safety, or personal rights risk to person in care.
