What the inspector wrote

At 11:30AM on 10/28/25, Licensing Program Analyst (LPA) Angela Luz arrived to the facility and met with Facility Representative (FR) Jeanne Burley to conduct an unannounced visit to deliver complaint findings. LPA toured the facility and observed 20 preschool children with four teachers. Per Licensee Svetlana (Lana) Costache's request, LPA called them for exit interview and report review. FR signed the report as the facility representative. During the investigation, LPA noted the following. Staff 1 (S1) and Staff 2 (S2) stated during interviews when their group of children are playing outside and one to two children have to use the bathroom, they stand in the classroom doorway with their back to the bathroom door. The bathroom door is always open. S1 and S2 cannot see the child inside as they are continuing to supervise the children playing on the yard. They stated they check in verbally with the child in the bathroom by asking if they are okay and asking if they need help. If more children have to use the bathroom, and there are two staff outside, one of the staff will take a small group inside to use the bathroom. Parent 1 (P1) stated during interview when they went to pick up their child, Child 7 (C7), they were in the bathroom with another child. P1 did not observe staff near the bathroom. The nearest staff was Staff 2 (S2) on the playground standing near the lunch tables. C7 was using the 3-year-old classroom bathroom so S2 could not see them from where they were standing. LPA stood in the doorway of the 3-year-old classroom near the lunch tables and confirmed a staff could not see into the bathroom from that vantage point. Adult 1 (A1) stated during interview that when children are playing outside in the large yard and need to use the bathroom, staff stand in the pre-k classroom doorway. A1 stated staff cannot see children use the toilet from where the stand but they can see children wash their hands. LPA stood in the pre-k classroom doorway and noted they could see the sink but not the toilet. LPA Angela Luz informed FR and Licensee that this report dated 10/28/25 documents one Type A citation which shall be posted for 30 consecutive days as there is an immediate risk to the health, safety, or personal rights of children in care. LPA informed the licensee to provide a copy of this licensing report that documents this Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. Notice of site visit was given and must remain posted for 30 days. Appeal rights provided. Exit interview conducted and report was reviewed with Licensee Svetlana (Lana) Costache via telephone and is signed by Facility Representative Jeanne Burley.

  • RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION

    (a) The licensee shall provide care and supervision as necessary to meet the children's needs. (1)No child(ren) shall be left without the supervision of a teacher at any time...Supervision shall include visual observation.This requirement is not met as evidenced by: Based on interviews and observations, staff do not visually observe children in the bathroom at all times. The licensee did not comply with the section cited above which poses an immediate health, safety or personal rights risk to persons in care.
