What the inspector wrote

On Wednesday, January 7, 2026, Licensing Program Analyst (LPA) Hanna Cha met with Licensee Mirian Garcia-Zaldana. The purpose of the visit was to conduct an unannounced Annual/Random inspection of the facility. LPA disclosed the purpose of the inspection to the licensee. LPA and licensee toured the facility. LPA observed licensee and assistant providing care and supervision to one infant, one preschool-aged child and one school-aged child. The current days and hours of operation are 23/hours; 7 days a week depending on family needs. LPA reminded licensee that licensee must stay awake during all hours children are awake. Physical Plant: This is a one-story family home. There is a living room, dining room, kitchen, four bedrooms, three restrooms, den, and back yard. Main care is provided in the living room and den referred to as the child care play area. The off-limit areas are the four bedrooms and two restrooms. Indoor/Children\342\200\231s Area: LPA inspected the indoor/children\342\200\231s area for safety, cleanliness and good repair. Licensee provides infants with playpens for napping. Per LPA observation, the fireplace is screened. The smoke detector and carbon monoxide detector tested to be in operable condition. There is a designated area for the ill children as necessary. Per licensee, there are no firearms/weapons on the premises. Bathroom: LPA observed the childcare bathroom. Children are provided with soap and towels. The toilet and faucet are in good operable condition. LPA reminded licensee to keep all hazardous items inaccessible to children. Kitchen: LPA inspected the kitchen for safety, sanitation, and good repair. Licensee provides all meals during operational hours. The knives and sharp items stored in kitchen cabinet, made inaccessible with a child safety lock. Outdoor/Children\342\200\231s Play Area: The backyard play area was observed for safety, good repair, age-appropriate toys/equipment, cushioned floors, and shady areas. There are no pools/spas/bodies of water on premises. Other: First Aid Kit on premises. Per Licensee, there is no smoking in the home. The cleaning products stored in high cabinet, out of reach of children. LPA observed a fire extinguisher (2A10BC). File Review: LPA reviewed Licensee\342\200\231s file and assistant\342\200\231s which included all required information. LPA reviewed two children files. Per record review, no documentation of 15- minute safe sleep logs for Child #1 (C1) were provided to LPA during inspection. Per licensee, C1 was placed on back to sleep for up to 12 months of age and was checked on by licensee every 15 minutes. However, licensee did not document sleep checks. LPA informed licensee that all infants (24 months and under) must have 15-minute safe sleep log documentation. A Technical Violation issued. The last disaster drill conducted on 10/2025. Licensee CPR/FA expires 2/2026 and Mandated Reporter training certificate expires 1/23/2026. Postings: Notice of Parent's Rights Poster (PUB 394), Facility License (LIC 203), Emergency Disaster Plan (LIC 610A). Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated. Any duly authorized officer, employee, or agent of the Department shall, upon presentation of proper identification, shall inspect the facility. The Licensee shall permit the Department to inspect the family childcare home, and to privately interview children or staff, to determine compliance with or to prevent violations of family child care laws or regulations. Also, to enter and inspect any place providing personal care, supervision and services at any time, with or without advance notice, to secure compliance with, or to prevent a violation. Licensee advised of the requirement to report Unusual Incidents. Licensee informed to utilize the Unusual Incident Report/Injury Report (LIC624B) when submitting a report to the department at: www.unusualincidentreport@dss.ca.gov . A report shall be made to the department by telephone or fax during the department's normal business hours before the close of the next working day following the occurrence during the operation of family day care home. In addition, a written report shall be submitted to the department within seven (7) days following the occurrence of any events specified above. LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for and removing any recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02-CCP. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. Licensee was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California. During the exit interview, the licensee Mirian Garcia-Zaldana, confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO profile in FAS. During this inspection, one Technical Violation issued. A notice of site visit was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with the licensee Mirian Garcia-Zaldana.
