What the inspector wrote

On 8/12/25 Licensing Program Analysts (LPA) Tyler Reyes conducted an unannounced Required - 3 Year inspection at the above facility. LPA met with Douglas Franco Site Supervisor and an Entrance Checklist - Child Care Centers LIC 125 was provided. LPA conducted a tour of the facility led by Site Supervisor Douglas. LPA observed (37) children in care. LPA observed (4) teachers and (3) aids. Hours of operation are Monday-Friday from 6:30AM-6PM. The facility is licensed to care for FACILITY IS LICENSED FOR 84 AMBULATORY CHILDREN. THE PROGRAM HAS 64 PRESCHOOL CHILDREN AGES 3 TO 5 YEARS OLD WITH A TODDLER OPTION. THE 20 TODDLERS ARE IN STARFISH AND ANGEL FISH CLASSROOMS. THIS IS A TITLE 5 PROGRAM. During the inspection, the following individuals were present at the center: Site Supervisor Douglas and Staff 1 (S1-S7). All adults present in the center have obtained a criminal record clearance or exemption. LPA informed that any individual that has direct contact with the children is required to have a criminal record clearance or exemption. The following was observed during the tour of the facility: (2) Toddler classrooms and (2) Preschool classrooms. Furniture and equipment were inspected for age appropriateness and good repair. Heating and cooling are provided by central air-conditioning. The telephone service is operational. Fire Extinguisher was observed near the front entrance. Fire Extinguisher was observed to be fully charged with a service tag of 10/7/24. LPA observed napping equipment to be clean and in good condition. Per Site Supervisor Douglas linens are washed by facility once a week and as needed. Page 1 of 5 LPA observed (2) age-appropriate toilets and (1) age-appropriate sink for the Toddler classrooms and (4) age-appropriate toilets and (4) age-appropriate sinks for the Preschool classrooms. LPA observed children’s cubies. The isolation area for sick children is a separate area of the classrooms. There are no firearms stored on the premises. There are no pools or bodies of water at the facility. Poisons/Cleaning Products: LPA issued a Technical Violation (TV) for a spray can of Raid which was observed in the off-limit kitchen underneath the kitchen sink. The cabinet did not have any locks. LPA observed additional cleaning products in Preschool classroom 1. A bottle of Clorox and multiple disinfectant spray bottles were stored in a top cabinet that was not locked. Food: Per Site Supervisor Douglas facility is part of a food program. The facility provides Breakfast, Lunch and a Snack. No reported children with food allergies are currently enrolled. All kitchen, food preparation, and storage areas are clean, free of litter, rubbish, and rodents/vermin. All food is protected from contamination. All storage containers for solid waste, including moveable bins, have tight fitting covers and are in good repair. Per PIN 21-21-CCP lead testing to be conducted. LPA observed a negative lead test result report dated 10/8/2022. Water is provided inside and outside by water jug with disposable cups. Facility Postings: LPA observed the required positing: Facility License, Menus, PUB 269 Child Passenger Restraints System Poster, PUB 393 Notification of Parents’ Rights, LIC 613A Personal Rights, Daily Activity Schedule, and LIC 9148 Earthquake Preparedness. Emergency Disaster Drill: Lockdown Drill 06/2025 Pediatric CPR/First Aid in Pediatrics Certification: Site Supervisor Douglas Completed 4/12/2025 and Renew By 04/2027 from American Heart Association and S1 Completed 6/10/2024 and Renew By 06/2026 from American Heart Association. Transportation: Per Site Supervisor Douglas transportation is not being provided. Page 2 of 5 Outdoor: LPA observed the (2) playgrounds. The playground equipment is in a safe condition, free of sharp, loose or pointed parts. The surface of the outdoor activity space is maintained in a safe condition and is free of hazards. There is adequate shade in the play yard. LPA discussed and provided copies of PIN 25-06 Extreme Heat Prevention. There are no pools or spas, or other bodies of water Staff Files: LPA reviewed Site Supervisor Douglas and S1’s file for the following documentation: Staff Qualifications, Proof of immunizations of measles, pertussis, and influenza, CPR and First Aid Certification, TB Clearance, LIC 503 Health Screening Report, LIC 9108 Statement Acknowledging Requirement to report Child Abuse, and Mandated Reporter Training Certificate, and LIC 9052 Employee Rights. (1) of (2) staff had required documentation. S1 was missing proof of a current Mandated Reporter Training Certificate which poses a potential health and safety risk. Children Files: LPA reviewed Child 1 (C1-C2) file for the following documentation: LIC 613A, Admission Agreement, LIC 700 Identification and Emergency Information, LIC 701 Physician’s Report, LIC 995 Notification of Parents’ Rights, and LIC 627 Consent for Medical Treatment, and Immunization. (2) of (2) children had required documentation. LPA discussed reporting requirements and the facility representative responsibilities as a mandated reporter, to report to Community Care Licensing and emergency personnel when necessary. Site Supervisor was reminded that all adults 18 and over, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated. Page 3 of 5 Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010, to test their water (used for drinking and food preparation) for lead contamination before January 1, 2023, and then every 5-years after the date of the first test. For child care center licenses issued after July 1, 2022, the licensee shall test their water for lead within 180 days of licensure pursuant to Written Directives section 101700 (PIN 21-21.1-CCP). LPA verified that the lead testing was completed in accordance to the Written Directives outlined in PIN 21-21.1-CCP . LPA referred Site Supervisor to the Department website for lead: Lead Toxicity Prevention and Water Testing Information . LPA discussed the safe sleep regulations with Site Supervisor and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed Site Supervisor of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02-CCP . When any IMS is provided, an updated Plan of Operation that includes IMS must be submitted to the Department. Site Supervisor was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California. During the exit interview, the Site Supervisor Douglas confirmed that there are no Registered Sex Offenders in the facility and LPA completed the RSO profile in FAS. Page 4 of 5 A notice of site visit was given and must remain posted for 30 days consecutive days. Failure to maintain posting as required will result in a $100.00 civil penalty.
