What the inspector wrote

Based on the information obtained during interviews, and LPA\342\200\231s observation at the time of the investigation, these allegations are determined and deemed Unsubstantiated. A finding that is unsubstantiated means, although the allegations may have happened or are valid, at the time of the investigation there is no preponderance of the evidence to prove that the alleged violations occurred. An exit interview was conducted, appeal rights, notice of site visit, and a copy of this report was provided to Facility Director on this date.

  • PERSONAL RIGHTS

    101223 (a)(1) Personal Rights: To be accorded dignity in his/her personal relationships with staff and other persons. This requirement was not met as evidenced by: LPA's observation witnessing (S1) and (S2) did not accord the child/children dignity when (S1) yelled at the (C1)while in care and while other children present. (S2) inappropriately interacted with (C1), (C2), (C3) and (C4). This poses a potential risk to the health and safety of the children in care.

    Personal Rights: To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including but not limited to... This requirement was not met as evidence by: LPA's observation: (S1) and (S2) humiliated/shamed, punished the child/ren in care while other children were present. (S1) yelled "shut your mouth" in close proximity addressing (C1). (S2) stated to multiple children "are you a baby" utilizing shame and used statements such as IF you..I am going to... This poses a potential risk to the health and safety of the children in care.
