What the inspector wrote

On 1/23/2023 , Licensing Program Analyst (LPA) Carol Heath conducted an unannounced Required 1-Year inspection at the Figueroa Family Child Care. Upon arrival, the LPA met with the licensee, Sara Figueroa, who guided the LPA on a tour of the facility. Family members residing in the home include 4 adults (licensee, her spouse & 2 adult children) . All adults living in the house have been background cleared. Per LIS, annual facility fees are current. Per the licensee, the hours of operation are Monday through Friday, 5:00 a.m. to 6:00 p.m. There were 2 daycare children present during this inspection. Per the licensee, she does not have children who need IMS at this time. The home is set up as follows: This is a two-story house with 6 bedrooms, 3 bathroom home with a kitchen/dining area, formal dining room, living room, laundry room, family room, and garage. The garage is used for storage, and no childcare activities are conducted there. The home was inspected for safety, comfort, cleanliness, telephone service, central air, and heat and ventilation. The home has central heating and air conditioning. All windows have screens and are free of cracks, bugs, and debris. There is no pool, spa, or other bodies of water on the premises. Main Area: Main care is provided in the living, and formal dining rooms. \302\267 Family Room: LPA observed age-appropriate toys and furniture for the children. A small table was observed with children size chairs. Several plastic storage bins were observed in which games and toys are stored for the children. There are games and books on the premises of this facility. There are mats on the floor with educational/learning activities. The mats were observed to be in good condition. \302\267 Children\342\200\231s Bathroom (#1): Children use the bathroom down the hall to the right. The bathroom was clean, sanitized, and in good repair. The Bathroom was toured and inspected sink/toilet is in operable condition. The toilet and faucets are clean, safe, and operable. All poison and medications are made inaccessible to children with child safety latches on the sink cabinet and drawers. The bathroom was observed to be free and clear of hazardous items. \302\267 Backyard: The backyard was inspected and gated all around. The outdoor play area was observed to be free of hazards and loose and sharp parts. The backyard is part of the childcare; there is a dirt and concrete area for active play. Children play in the backyard (not in use due to weather). There are large anchored play structures and age-appropriate toys. There is a grassy area and a concrete area for active play. The right side of the home is gated, where tools are stored and made inaccessible to children. \302\267 Off-limit : Off-limit areas include the home's entire gated upstairs (4 bedrooms, 2 bathrooms), downstairs bedroom (roommate), kitchen (gated on both sides), laundry room (child locked), and garage. Family room and formal dining room: In the family room, LPA observed a fireplace that was properly screened via a mirror glass barrier, making it inaccessible to children. However, due to the covid, this area is not open. \303\230 \302\267 Kitchen/Dining Room: The kitchen was inspected to ensure hazardous and dangerous items were inaccessible to children (Safety latches). All sharp utensils, poisons, and medications are made inaccessible to children in the kitchen with child safety latches on cabinet doors and drawers. Sharp knives are made inaccessible in the child-locked drawer. \303\230 Others: \302\267 AC/Heating Unit / Swamp Cooler unit was observed. AC/Heating Unit is located on the right side of the home and is inaccessible to children via barrels blocking access to the AC unit. \302\267 Bodies of water: Pre the licensee, there were no bodies of water in the home. LPA observed a fish pond in the front yard without water. The children are playing in the backyard. The front yard is only for pick up and drop off. LPA and the licensee asked the licensee to make the area inaccessible to the children, \302\267 Electrical outlets: All unused electrical outlets are plugged in and made inaccessible to children. \302\267 Food: The licensee is enrolled in Food program. The licensee will provide Breakfast, lunch, and snacks. \302\267 Fire extinguisher (2A10BC) : LPA observed a required fire extinguisher (2A10BC) reading in Green and located in the kitchen, inaccessible to children. It meets standards established by the State Fire Marshall. \302\267 Fireplace: The fireplace was observed in the living room and is screened to make it inaccessible to the children. \302\267 Hanging window blind cords : The cords are inaccessible to children. \302\267 Incidental Medical Services (IMS): Incidental Medical Services (IMS) policy was discussed. For IMS information, see Evaluator Manual - Regulation Interpretations and Procedures for Family Child Care Homes Section 102417. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. The licensee will not be providing IMS to the children at this time. \302\267 Isolation area (Illness): Per the licensee, if the child shows signs of illness, they will be separated from other children and stay in classroom \302\267 Medications and cleaning solutions : Detergents/cleaning compounds are locked under the kitchen sink with a child. Medications are in the off-limits bedroom. \302\267 Napping: Children will nap in designated areas with adult supervision. LPA observed 12 mats in the closet. \302\267 Overnight Care: According to the licensee does not provide overnight care. \302\267 Pets: There is 3 small dog, and he/she has current vaccinations. The dog does not interact with childcare children. \302\267 Phone service: There is a working landline or cell phone \302\267 Smoke Detectors and Carbon Monoxide: The smoke detectors and carbon monoxide devices tested operable. \302\267 Stairs (For two-story hours): A safety gate is barricaded to make the stairs inaccessible to the children. \302\267 The First Aid kit is located in the front door closet, inaccessible to children. The First Aid Kit was observed to be complete with supplies and a first aid manual . \302\267 Transportation : The licensee does provide transportation for children. The licensee has a valid California driver's license, valid vehicle insurance, and vehicle registration. \302\267 Weapons or Firearms: Per the licensee, there are No Firearms at the facility at this time. LPA does not observe any firearms. \303\230 Documentation: \302\267 Child files : LPA observed that 8 children's files contained all required licensing documents. \302\267 CPR/First Aid: LPA observed licensee has current Pediatric CPR and First Aid Training with an expiration date (of 12/2023) 1 hour of nutrition training, (8) hours of Preventive Health and Safety Training. \302\267 Criminal Record: Pre Guardian, all adults in this facility obtain a criminal record clearance. \302\267 Facility fees: Per Licensing Information System, annual facility fees were current. \302\267 Fire Drill and Disaster Drill: Per the licensee, fire, and disaster drills are conducted every 6 months; the last drill was documented and performed on 11/11/2022 . \302\267 Facility Roster: LPA observed Child Care Facility Roster is up today. Per Licensing Information System, annual facility fees were current. \302\267 Immunization: The licensee and her assistant have the required immunizations (MMR and DTaP). The licensee and her assistant provided a written statement declining the influenza vaccination. \302\267 Infant Sleeping Plan (LIC 9227) and Sleeping Log: LPA shared the information with the licensee. Per the licensee, NO infant (0-12 months) is enrolled in the facility. \302\267 The licensee has posted as required the Facility License , Emergency Disaster plan , Earthquake Preparedness, and Parents' Rights Poster \302\267 Mandated Reporter Training: The licensee has completed and renewed the online mandated reporter training at www.mandatedreporterca.com on 2/8/24 \302\267 Staff Personnel File: LPA observed 1 staff information. The file contained all required licensing documents. LPA observed LIC 508, 9052, IZ, TB test, LIC 9108, Mandated Reporter Training, and CPR/First Aid certificates. \302\267 Staffing Ratio and Capacity: This is a large family childcare facility. During the inspection, LPA observed 2 children (36 and 33 months old) \303\230 The following information was discussed with the licensee : \303\274 Mandatory Forms for the children's files and provider's files. \303\274 Requirements for fire drills, earthquake drills, and documentation for both. \303\274 The licensee is reminded that 100% supervision is required for children at all times. \303\274 Capacity requirements, Roster requirements, Posting requirements, and Documentation requirements for disaster drills (fire and earthquake). Mandatory Forms for the children's and provider's files and Safe Sleep Awareness. The role and responsibilities of being a mandated reporter were reviewed. The licensee was reminded that supervision is always required for children in care. \303\274 Licensee was made aware that it is their responsibility to know the regulations and anyone who assists in providing care. Licensee was advised that the inaccessibility of hazards must be constantly reassessed depending on the children in care. Licensing must always have the facility's phone number; if the phone number is changed, licensing must be notified. \303\274 Licensee was advised of the requirement to report unusual incidents and injuries to the parent/guardian and Licensing within the time frame specified by the regulation and on the form LIC624B \303\274 The licensee was informed of the responsibility to report suspected Child Abuse by calling the Child Abuse Hotline at 1-800-540-4000. Also, call the CCL office and follow up with a written Unusual Incident/Injury Report (LIC 624B). \303\274 Criminal Record Statement: Licensee [or facility representative] was reminded that all adults 18 and over living or working in the home, including employees and volunteers, must obtain a criminal record clearance or exemption or transfer their existing support or exemption prior to the initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated. \303\274 Safe Sleep: LPA discussed the safe sleep regulations with the licensee [or facility representative] and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed the licensee [facility representative] of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. \303\274 A baby walker shall not be allowed on the premises of a family child care home in accordance with Health and Safety code sections 1596.848(b) and (c). \303\274 Notice of Site Visit: A notice of site visit was given and must remain posted for 30 days. \303\274 Posting Requirements: Failure to comply with posting requirements shall result in an immediate civil penalty of $100. \303\274 The regulation prohibits the smoking of tobacco in a private residence that is licensed as a family childcare home and in those areas of the family day care home where children are present (24/7 ban). \303\274 State law prohibits baby walkers, bouncy seats, exersaucer, and other items that fall into that category. \303\274 Licensee was advised to visit the CCL website ( www.ccld.ca.gov ) to obtain updates on courses and updates/changes to the regulations. n Our Quarterly updates come out every 3 months. Child Care Advocates information: www.childcareadvocatesprogram@cdss.ca.gov \303\274 The Duty Worker is available for questions Monday through Friday at (661) 202-3318 from 8:00 a.m. - 5:00 p.m. \303\274 A copy of the Safe Sleep Proposed Regulations was provided to the licensee. No deficiencies are being cited at this time; the facility complies with Title 22 An exit interview was conducted, and the report was reviewed with the licensee Sara Figueroa .
