What the inspector wrote

During a complaint investigation, Licensing Program Analyst (LPA) Angela Luz noted that one Staff (S1) did not have a criminal record clearance until after they started working at the facility. S1 worked at the facility beginning in March 2025 and did not get eligible clearance until August 2025. S1 is not associated to the facility at the time of today's visit. LPA reminded Director Jeannine Pignotti that all adults 18 and over, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5 days per person will be assessed if this regulation is violated. A civil penalty of $100 x 5 days is hereby assessed for a total of $500. LPA instructed Director to wait for an invoice from the Department for instructions for payment. LPA Angela Luz informed Director Jeannine Pignotti that this report dated 9/10/25 documents one Type A citation. LPA informed director to provide a copy of this licensing report dated 9/10/25 that documents this Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. A notice of site visit was given and must remain posted for 30 days. Appeal Rights provided. Exit interview conducted and report was reviewed with Director Jeannine Pignotti.
