Inspector’s narrative

What the inspector wrote

PAGE 2 Based on investigation that included interviews with licensee, staff, children information revealed that on more than one occasion the licensee utilized inappropriate discipline to get children to comply. Most recently the utilized a pointer stick to discipline a child. The preponderance of evidence standard has been met; therefore, allegations of personal rights is found to be Substantiated. Upon receipt of this report, the Licensee shall post the Notice of Site Visit (LIC 9213) and any Licensing report documenting a type \342\200\234A\342\200\235 deficiency. The report and the Notice of Site Visit shall be posted for 30 consecutive days. Failure to maintain posting as required, will result in an immediate $100 civil penalty. A copy of this report shall be provided to the parent/guardian of children currently enrolled by the next business day or immediately upon return. A copy of this report shall also be provided to the parent/guardian of any newly enrolled children for the next 12 months (1 year). The Acknowledgement of Receipt (LIC 9224) form must be maintained in each child\342\200\231s file immediately upon receipt from parent. Licensee was provided with a copy of the Acknowledgement of Receipt of Licensing Reports (LIC 9224). Exit interview was conducted. The report was read and provided to the licensee. The Notice of Site Visit was provided. A copy of appeal rights was provided to licensee.

    102423 (a) (4)(Personal Rights - Each child receiving services from a family child care home shall have certain rights that shall not be waived or abridged by the licensee regardless of consent or authorization from the child's authorized representative. These rights include, but are not limited to, the following:To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse, or other actions of a punitive nature, including, but not limited to: interference with eating, sleeping or toileting;... This requirement was not met as evidenced by: Based on investigation Licensee used of inappropriate discipline and a pointer stick. In addition, the other staff have used a pointer stick. This is a Type A violation. This is an immediate risk to the health and safety of children in care.
