What the inspector wrote

According to Staff interviewed during the course of the investigation, staff stated that it is not a regular occurrence but it has happened in the past due to emergency circumstance, for example staff being out sick and facility awaiting a substitute teacher. According to Parents interviewed during the course of the investigation, parents stated that they have never observed more that 12 children being supervised by one adult. Based on the evidence as documented above, the allegations have been determined to be Unsubstantiated. A finding that the complaint is unsubstantiated means that although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the allegation occurred. A notice of site visit was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with Director, Karen Beninati and Jezyka Roldan.

(1) No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation. This requirement is not met as evidence by: Based on observations and interviews, facilty did not comply with ensuring children had direct supervision at all times. This poses an immediate risk to children in care.
