What the inspector wrote

On 11/1/2024, Licensing Program Analyst (LPA) Suzette Ornelas conducted an unannounced case management inspection for the purpose of deficiency observed during a complaint investigation on 10/24/2024 for complaint control # 58-CC-20241017143237 . Upon arrival LPA was greeted by Jezyka Roldan and observed 12 children and 5 adults. During the initial 10 day inspection for complaint control # 58-CC-20241017143237 on 10/24/2024, LPA observed 4 infants alone in the infant nap room without any adult supervision as well as closed doors. On 10/24/2024, LPA explained to the Director that napping children are never to be left alone in any room without any adult supervision. Director understands and will comply. During todays visit on 11/1/2024, upon verifying all adults present at the facility had criminal record clearance, LPA observed Staff 1 (S1) was not yet eligible/cleared, nor associated. LPA was able to confirm that live scan was still requiring further action. LPA provided lead teacher with pending documents form from Guardian and lead teacher agrees to comply by following up with Guardian via guardian@dss.ca.gov to ensure S1 returns to work once eligible. The following Type A deficiencies are being cited on 11/1/2024 in accordance to Title 22 of the California Code of Regulations: 10/24/2024 - 101429(a)(1)(2)-Responsibility for Providing Care and Supervision for Infants (a) In addition to Section 101229, the following shall apply: (1) Each infant shall be constantly supervised and under direct visual observation and supervision by a staff person at all times. (2) Sleeping infant(s) shall be directly observed by sight and sound at all times. 11/1/2024- 101170(e)(2)CRIMINAL RECORD CLEARANCE All individuals are subject to a criminal record review prior to working. Individuals must be fingerprint cleared and associated to the facility. Please refer to 809D for 2 cited deficiencies. Upon receipt, the Licensee shall post the Notice of Site Visit and the Licensing report. This report and the Notice of Site Visit shall be posted for thirty (30) consecutive days. Failure to maintain posting as required will result in a $100 civil penalty. A copy of this report shall be provided to the parents/guardians of the children currently enrolled by the next business day or immediately upon return. A copy of this report shall also be provided to the parents/guardians of any children newly enrolled at the facility for the next twelve (12) months. The LIC 9224 Acknowledgement of Receipt of Licensing Reports must be maintained in each child's file immediately upon receipt from the parent. A copy of this report, notice of site visit, and appeal rights were provided. The Notice of Site Visit (LIC 9213) – must remain posted for 30 days during the hours of operation after each site visit by a licensing representative. Failure to maintain posting as required will result in a civil penalty of $100.00. Exit interview was conducted with lead teacher, Jezyka Roldan.

This requirement is not met as evidence by: Based on observations and interview made on 10/24/2024 LPA observed 4 sleeping infants were left alone in the nap room with the douors closed and without any adult supervision. This poses an immediate risk to infants in care.
