What the inspector wrote

On 9/8/2023, Licensing Program Analyst (LPA) V. Wheatley conducted an unannounced inspection and met with the director Darlene Estrada. The director lead LPA on a tour of the facility. At approximately 11am the licensee Paola Terzoli arrived and joined the inspection. LPA observed 18 children in Classroom #2 with theree staff members. LPA observed 17 children in the preschool classroom #3 (preschool) with two staff members and a music teacher. LPA reviewed transcripts and observed one of the staff members (Staff #1) has only 3 units completed in the file on the premises. Based on LPA's observation, and record review the allegation for out of ratio is substantiated. See LIC 9099 D. Exit interview. A copy of this report will be provide.

    LIMITATIONS ON CAPACITY

    101161(a) -Limitations on Capacity-A licensee shall not operate a child care center beyond the conditions and limitations specified on the license, including the capacity limitation. This was evidence by:LPA observed 18 children (toddlers) in Classroom #2. The room is licensed for 17 toddlers maximum. This is an immediate risk to the health and safety of children in care.

    101216.3(b)(1)Teacher-Child Ratio - The licensee may use teacher aides in a teacher-child ratio of one teacher and one aide for every 15 children in attendance. A ratio of one fully qualified teacher (as specified in Section 101216.1(c) and one aide for every 18 children in attendance in a preschool program is allowed when the aide meets the qualifications specified in Section 101216.2(d).An aide assisting a fully qualified teacher (as specified in Section 101216.1(c)) in the supervision of up to 18 preschool-age children, pursuant to Section 101216.3 shall meet the following requirements:(1) Completion of six postsecondary semester or equivalent quarter units in early childhood education or child development This was evidence by:LPA reviewed the staff records and observed Staff #1 with only one Child Development class in the file. Two classes are required when there are over 15 children in the classroom. This is an immediate risk to the health and safety of children in care.
