What the inspector wrote

During the interview with the Director, it was disclosed that the Type A citations issued on 5/16/24 were not posted at the facility, as required for 30 days. During the visit conducted on 5/29/24, LPA Katrdzhyan toured the facility and did not see the Type A citations (dated 5/16/24) posted at the facility. Statements obtained from the Director corroborated with the observations of the LPA. According to the Director, copies of the Licensing reports dated 5/16/24 were not provided to all of the parents. The Director only provided copies to the parents who requested them. Based on LPA’s observations and interviews which were conducted and record reviews, the preponderance of evidence standard has been met, therefore the above allegations are found to be Substantiated. California Code of Regulations, (Title 22), are being cited on the attached LIC 9099D. The Notice of Site Visit was provided and must remain posted for 30 days during the hours of operation after each site visit by a licensing representative. Failure to maintain posting as required will result in a civil penalty of $100.00. Exit interview was conducted with Marisol Nepomuceno and Appeals Rights provided. During the interview with the Director / Marisol Nepomuceno, the Director denied not allowing a child's responsible party to review the facility's recent licensing reports. It was stated that all pages of the licensing reports were provided to parents who requested them. Based on the investigation conducted, there is insufficient evidence to support the above-mentioned allegation to be true. Therefore, although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is Unsubstantiated. The Notice of Site Visit was provided and must remain posted for 30 days during the hours of operation after each site visit by a licensing representative. Failure to maintain posting as required will result in a civil penalty of $100.00. Exit interview was conducted with Marisol Nepomuceno and Appeals Rights provided.

A licensee shall not operate a child care center beyond the conditions and limitations specified on the license, including the capacity limitation.This requirement is not met as evidenced by: During a cite visit conducted at the facility on 6/4/24, LPA toured the facility with the assistance of the Director / Marisol Nepomuceno at 1:30PM and observed 77 children with 6 staff present in the preschool program. The facility is licensed for a maximum capacity of 70 children.
