What the inspector wrote

On 01/10/2023 at 9:57 am Licensing Program Analysts (LPAs) Deborah Lowe and Lilia Hernandez conducted an unannounced visit, LPAs Lowe and Hernandez met with Licensee, Yafa Ifrah. At 9:57 am LPAs Lowe and Hernandez observed 14 children under supervision of licensee and 1 staff (S1). LPAs interviewed licensee who stated facility has 14 children enrolled and all children enrolled were present. LPAs reviewed Child Care Facility Roster and found within the 14 children present, 3 were infants under the age of 2, and 11 children present were children age 4 years and younger. No kindergarten or school age children age 6 or above were listed as enrolled or present during visit. Facility is found to be out of ratio. LPAs advised per H&S Code 1597.465 (a) Large family day care homes; number of children: A large family day care home may provide care for more than 12 children and up to and including 14 children, if all of the following conditions are met: (a) At least one child is enrolled in and attending kindergarten or elementary school and a second child is at least six years of age. LPAs reviewed facility license with licensee and read in the comments that state: Max Cap (when there is an assistant present) 12 - No more that 4 infants. Cap 14 - No more than 3 infants, 1 child in Kindergarten or Elementary school, and 1 child at lease age 6. Licensee called for two children to be picked up. LPAs observed two children leaving facility at 11:14 am. At 11:14 am LPAs observed 12 children under supervision of licensee and S1. LPAs Lowe and Hernandez informed licensee Yafa Ifrah that this report dated 01/10/2023 documents 1 Type A citation which shall be posted for 30 consecutive days as there is immediate risk to the health, safety, or personal rights of children in care. Also, LPAs Lowe and Hernandez informed the licensee Yafa Ifrah to provide a copy of this licensing report dated 01/10/2023 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. LIC 9213 Notice of site visit and appeal rights were provided and reviewed. An exit interview was conducted with Licensee, Yafa Ifrah. A copy of this report was provided.

This poses a potential Health and Safety risk to clients in care.”

These rights include, but are not limited to, the following: (2) To receive safe, healthful, and comfortable This Requirement is not met as evidenced by:Based on LPAs observations, interviews with LIcensee and B1, facility has an unapproved construction of an attached roof structure at the rear of the facility over the children outdoor play area which poses an immediate health, safety or personal rights risk to person in care.
