Inspector’s narrative

What the inspector wrote

On July 28, 2021 Licensing Program Analyst (LPA), V. Wheatley conducted an unannounced Annual Required Inspection and was met by Licensees, Alicia Arce and Cynthia Villa. Upon arrival, LPA was greeted by Ms. Villa. Licensee Arce arrived at 3PM. Days and hours of operation are Monday through Friday, LPA toured the home inside and outside and a census was taken. Current facility sketch reviewed and confirmed that the living room and bathroom are used for providing care and are accessible to children. All other rooms are off-limits and made inaccessible by use of locks. There are no firearms or ammunition on the premises. Detergents, cleaning compounds, medication and other hazardous items were made inaccessible during the inspection. There is a working fire extinguisher, smoke detector, carbon monoxide detector and adequate heating and ventilation for safety and comfort. There is a screened wall heater in the living room which needs to be mounted. There are no stairs in the home. Safe toys and play equipment are observed. The home has working telephone service and LPA confirmed the phone number is 310-986-0818 or 702-439-4224. There is no swimming pool or other bodies of water on the premises. LPA discussed Safe Sleep Regulations with licensee. Cribs and play yards will be kept free from all loose articles and objects while infants are sleeping, and there are no objects hanging above or attached to the crib or play yard. Infants are not swaddled while in care. Provider physically checks on sleeping infants every fifteen minutes and documents any signs of distress which includes but is not limited to flushed skin color, increase in body temperature, restlessness and labored breathing. Infants can be visually observed through an open door if sleeping in a separate room. Individual Infant Sleeping Plan is completed and in file for each infant up to 12 months of age. Infants up to 12 months of age are placed on their backs for sleeping. Licensee ensures that children in care are supervised at all times and is aware children shall not be left in parked vehicles. Car seats are used for transportation purposes only and are not used for sleeping children. The outdoor play area in the backyard is fenced and there are no hazards to children present. Capacity as specified on the license is being maintained. LPA reviewed a sample of children\342\200\231s files and observed files were complete with emergency information as required. Licensee\342\200\231s Mandated Reporter Training was completed in 2019. Licensee\342\200\231s pediatric CPR/First Aid expires on June 2023. A review of records indicates that all employees and/or volunteers have immunization records on file for influenza, pertussis and measles. All adults who reside or work in the home have a criminal record clearance or exemption. There are no excluded individuals present at this home. Incidental Medical Services (IMS) are not currently being provided. Licensee is aware that an IMS plan is required to be submitted to the licensing office if they provide any of these services. Information regarding Americans with Disability Act (ADA) can be obtained by contacting US Department of Justice toll free ADA Information line at (800) 514-0301(voice), (800) 514-0383 (TDD) and website link https://www.ada.gov/childqanda.htm . LPA and Licensees discussed the Community Care Licensing website www.ccld.ca.gov which will provide access to Provider Information Notices (PINs), Quarterly Updates, COVID-19 Information and Resources, Mandated Reporter Training, Safe Sleep in Child Care, Lead Poisoning Facts, Forms and Regulations. Per Title 22, Division 12, Chapter 3, of the California Code of Regulations, the licensees are being cited for having a swimming pool on the premises without notifying the department. LPA observed an above ground swimming pool in the backyard with a five feet fence. This report shall be made available to the public upon request. LIC 9213 Notice of Site Visit is provided and required to be posted for 30 days. Exit interview. A copy of this report was emailed to the licensee.

    102416.3(a)(3)-Alterations to Existing Buildings or Grounds -Prior to making alterations or additions to a family child care home or grounds, the licensee shall notify the Department of the proposed changed, including, but not limited to, the following: (3) Installation of in-ground or above-ground swimming pools, spas, fish ponds, ....or other bodies of water. Licensees failed to inform the Department that an above ground swimming pool was installed on the premises in the backyard. This is a risk to the health and safety of children in care. The standard was not met:

    102417(g)(5)(B)-Operation of a Family Child Care Home (g)(5)(B) The home shall be free from defects or conditions which might endanger a child. Safety precautions shall include but not be limited to: (5)All licensees shall ensure the inaccessibility of pools (in-ground and above-ground), fixed-in-place wading pools, hot tubs, spas, fish ponds and similar bodies of water through a pool cover or by surrounding the pool with a fence.Where an above-ground pool structure is used as the fence or where the fence is mounted on top of the pool structure, the pool shall be made inaccessible when not in use by removing or making the ladder inaccessible or erecting a barricade to prevent access to decking. If a barricade is used, the barricade shall meet the requirements of Section 102417(g)(5)(A). The standard was not met. Licensees failed to install the proper fencing for the above ground pool. LPA observed several inches under the fence and the self latching gate is not working. LPA tested the latching and it does not close on its own. LPA also observed the ladder for the pool inside of the pool.
