Inspector’s narrative

What the inspector wrote

On 6/22/2021 at 1:00 PM, Licensing Program Analyst (LPA) Loyce Phillips, conducted an unannounced Annual Required Inspection and was met by Licensee, Sharon Oren . Also present was Staff #1 (S1). Days and hours of operation are from 9:00am to 3:00pm. LPA toured the home inside and outside and a census was taken. LPA observed 18 children in care, 4 children 14 years of age and 1 additional Staff (S1). Current facility sketch reviewed and Licensee confirmed that the art studio and bathroom down the hall to the right and front outdoor area are accessible to children. All other rooms are off-limits and made inaccessible by use of door locks. There is a fish pond in the front area of the home with a fenced gate that measures about 5 ft. that is self closing and self latching. The fish pond area is off limits. There is a swimming pool completely empty of water. The swimming pool area has a fenced that is measure about 5ft and 7 inches that is self closing and self latching. The backyard is off limits. There are no firearms or ammunition on the premises. All poisons, detergents, cleaning compounds and other hazardous items are kept under the kitchen sink and made inaccessible with a child safety latch. Medications are stored in an upper kitchen cabinet made inaccessible by child safety lock. The fireplace is located in the master bedroom and made inaccessible by a key door lock. There is a working fire extinguisher, smoke detector, carbon monoxide detector and adequate heating and ventilation for safety and comfort. There are no stairs in this home. Safe toys and play equipment are observed. The home has working telephone service and LPA confirmed the phone number is (818) 398-8988. There are currently no infants in care. LPA discussed Safe Sleep Regulations with licensee. Which includes each infant in care should have their own crib or play yard. The cribs and play yards should be kept free from all loose articles and objects while infants are sleeping; and there should be no objects hanging above or attached to the crib or play yard. Infants should not be swaddle while in care. Licensee will physically check on sleeping infants every fifteen minutes and documents any signs of distress which includes but is not limited to flushed skin color, increase in body temperature, restlessness and labored breathing. Infants should be visually observed through an open door if sleeping in a separate room. Individual Infant Sleeping Plan is completed and placed in the file for each infant up to 12 months of age. Infants up to 12 months of age are placed on their backs for sleeping. Licensee ensures that children in care are supervised at all times and is aware children shall not be left in parked vehicles. Car seats are used for transportation purposes only and are not used for sleeping children. The outdoor play area is in the front yard is fenced and there are no hazards to children present. Capacity as specified on the license is being maintained. LPA reviewed a sample of children’s files and observed files were not complete with emergency information as required. Licensee’s Mandated Reporter Training was completed on 12/30/2019 Licensee’s pediatric CPR/First Aid expires on 6/13/2023. A review of records indicates that Licensee have immunization records on file for influenza, pertussis and measles. All adults who reside or work in the home have a criminal record clearance or exemption. There are no excluded individuals present at this home. Incidental Medical Services (IMS) are not currently being provided. Licensee is aware that an IMS plan is required to be submitted to the licensing office if they provide any of these services. Information regarding Americans with Disability Act (ADA) can be obtained by contacting US Department of Justice toll free ADA Information line at (800) 514-0301(voice), (800) 514-0383 (TDD) and website link https://www.ada.gov/childqanda.htm . LPA and Licensee discussed the Community Care Licensing website www.ccld.ca.gov which will provide access to Provider Information Notices (PINs), Quarterly Updates, COVID-19 Information and Resources, Mandated Reporter Training, Safe Sleep in Child Care, Lead Poisoning Facts, Forms and Regulations. Per Title 22 Division 12, Chapter 3, of the California Code of Regulations, the following deficiencies are cited: (see next page 809 D). Licensee was provided a copy of appeal rights. An exit interview was conducted, a copy of this report was read and provided to the Licensee, Sharon Oren. The report shall be made available to the public upon request. LIC 9213 Notice of Site Visit was provided and required to be posted for 30 days.

    102416.5(a) Staffing Ratio and Capacity: The capacity specified on the license shall be the maximum number of children for whom care may be provided at any one time. The total licensed capacity for a Small Family Child Care Home shall not exceed eight children. This requirement is not met as evidence by: based on LPA observations Licensee had 18 children in care. This poses an immediate health and safety risk to children in care.

This requirement is not met as evidenced by: based on LPA observations, the licensee failed to provide complete copies of childrens file. This poses a potential health and safety risk to children in care.

    On and after January 1, 2018, a person who becomes an... employee of a licensed child day care facility shall complete the mandated reporter training provided ...within the first 90 days that he or she is employed at the facility and shall complete renewal mandated reporter training every two years...This requirement is not met as evidenced by: On 6/22/2021 a review of records was conducted and LPA did not observe the mandated reporting certificate of completion for Staff 1. This is a potential health and safety risk to children in care.
