What the inspector wrote

Per title 22 regulations (i)If an infant falls asleep before being placed in a crib or play yard, the provider shall move the infant to a crib or play yard as soon as possible. Based upon evidence obtained during this investigation, the allegation Licensee allows infants to sleep in unsafe equipment, have been determined to have been determined to be unsubstantiated. A finding that a complaint is unsubstantiated means that although the allegation may have happened or is valid, there is not a preponderance of evidence to prove that the alleged violation occurred. Notice of site visit was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with Licensee Sophia Tourneh. Per title 22 regulations 102416.5 A large family day care home may provide care for more than 12 children and up to and including 14 children, if all of the following conditions are met: (a) At least one child is enrolled in and attending kindergarten or elementary school and a second child is at least six years of age. (b) No more than three infants are cared for during any time when more than 12 children are being cared for. (c)The licensee notifies a parent that the facility is caring for two additional school age children and that there may be up to 13 or 14 children in the home at one time. The licensee is caring for more than 3 infants and there is no record of notification to the parents that 2 additional children are in care, (LIC 9150) in the children’s files, The facility is over capacity. Pertaining to the allegation: Licensee does not provide adequate sleeping accommodations for infants. Per Reporting Party, infants are sharing cribs to sleep in because they did not observe enough cribs in the home for the number of infants that were usually present. LPAs toured the home and observed 2 cribs. Per licensee when children fall asleep, they are moved to the crib. Licensee stated the children take turns in the cribs. if no cribs available they sleep on the mats. Licensee disclosed they change the sheets every 2-3 days and do not change the bedding after every child. LPA observed 2 different infants in the crib with the same bedding. Per title 22 regulation 102425 (a)There shall be one crib or play yard for each infant who is unable to climb out of the crib or play yard. (6) Each infant's bedding shall be used for him/her only. Bedding that touches the infant’s skin shall be cleaned at least weekly or before use by another infant. Based upon evidence obtained during this investigation, the allegations "Licensee is operating facility over capacity and Licensee does not provide adequate sleeping accommodations for infants", have been determined to be Substantiated. A finding that the complaint is substantiated means that the allegation is valid because the preponderance of the evidence standards has been met. Exit interview conducted and report was reviewed with Licensee Sophia Tourne. Notice of site visit was given and must remain posted for 30 days.h.
