video of the alleged incident and LPA did not observe Staff 1 handling Child 1 in a rough manner. In the surveillance video, Child 1 is observed being placed down near the outside table by parent, at which time Staff 1 is observed getting close to Child 1. As parent of Child 1 is observed walking away from Child 1, Child 1 is seen running after parent at which time Staff 1 is observed trying to grab the arm of Child 1 but no contact is made as Child 1 is observed being picked up and carried by parent. During the interview with staff, staff made no disclosures about staff handling a day-care child in a rough manner and denied the allegation to be true. During the interview with Staff 1, Staff 1 denied handling Child 1 in a rough manner. The statements obtained were consistent and corroborated with the statements obtained from the Director. Parents interviewed did not present concerns related to the above-mentioned allegation and were pleased with the interaction between staff and children at the day care center. Based on the investigation conducted, there is insufficient evidence to support the above-mentioned allegation to be true. Therefore, although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is Unsubstantiated. The Notice of Site Visit was provided and must remain posted for 30 days during the hours of operation after each site visit by a licensing representative. Failure to maintain posting as required will result in a civil penalty of $100.00. Exit interview was conducted and report was reviewed with the Assistant Director and Appeals Rights provided.
