What the inspector wrote

On 10/20/2022 at 8:45 a.m. Licensing Program Analysts (LPAs) Deborah Lowe and Antonio Almanza met with Administrator Robina Petrossian . The purpose of the visit was an announce case management – licensee initiated inspection at the facility to ensure that health, safety and personal rights as requires by Title 22 and Health and Safety Regulations governing California Child Care Centers will be met. There were 7 Infants were present during this inspection. This is a capacity increase application for 25 Infants with a Toddler Option, ages 6 weeks to 30 months (2 ½ years). The child care center will operate Monday – Friday 6:30 a.m. – 6:00 p.m. The fire clearance was approved on 8/15/2022. Licensee has a Preschool License #197493654. LPAs Lowe and Almanza toured and measured the on-limits areas and classrooms located at the facility. Director Nancy Romero (Garza) and Corporate Board Member Armond Asadurian were also present for the visit. The facility has a total of 2 infant classrooms. Children will have access to 2 sinks and 3 toilets. Classroom measurements are : Room 1 Toddler Option Indoor total measurements 385.42 square (sq) feet (ft) divided by 35 sq ft = 11 toddler option. Room 2 Infant Room Indoor total measurements 433.41 sq ft divided by 35 sq ft = 12 infants Outdoor Play measurements are: Outdoor total measurements: 1,689.65 sq ft divided by 75 sq ft = 22 infants/ toddler option. Facility has submitted a request for a waiver for infants and toddler to use the same outdoor space with alternating schedules to ensure infant and toddlers will not commingle. Indoor/Children’s Area: Indoor activity space for infants was observed to be physically separate from space used by children in the child care center components. All outdoor and indoor passageways and other areas of potential hazard were observed to be free of obstruction. The child care center was observed be clean, safe, sanitary and indoor classrooms in good repair. Floors of all rooms have a surface that is safe and clean. A comfortable temperature for children was observed to be maintained at all times. The infant care center was observed to be equipped with appropriate furniture and equipment including, but not limited to, cribs and cots; changing tables; and feeding chairs. Tables and chairs were observed to be meet the needs of the children. LPAs advised furniture shall be maintained in good repair and safe condition. The type, height and size of furniture and equipment shall be age appropriate. LPAs advised Swings, playpens and all such equipment and furniture shall be assembled or installed according to the manufacturer's instructions and shall be maintained in good repair and safe condition. Classroom toys were observed to be safe, and without sharp points or edges or splinters, or be made of small parts that can be pulled off and swallowed. LPAs advised rattles shall be large enough so that they cannot become lodged in an infant's throat and constructed so that they will not separate into small pieces. LPAs observed each child has an individual permanent space for his/her clothing, personal belongings and/or bedding. All materials and surfaces accessible to children, including toys, were observed to be free of toxic substances. Drinking water was observed to be available with the use of water cooler system. The water cooler was observed with a hot water tab the facility has secured and made inaccessible to children. The water cooler was located in the walk way between Room 1 and Room 2. Per licensee they handle pest control to take measures to keep the center free of flies, other insects, and rodents. All containers used for storage of solid wastes were observed to have tight fitting lids. No fireplaces or open-faced heaters were observed in Rooms 1 or 2. All window screens were observed to be in good repair and free of insects, dirt and debris. Disinfectants, cleaning solutions, poisons and other items that could pose a danger if readily available to children were observed to be stored where inaccessible to children. LPAs advise storage areas for poisons shall be locked. LPA observed a current edition of a first-aid manual, sterile first-aid dressings, bandages or roller bandages, adhesive tape, scissors, tweezers, thermometer, and antiseptic solution. page 2 LPAs observed the isolation area to be located in the office. A cot and a folding crib was observed to be used in the isolation area. LPAs advised any infant in the isolation area shall be under constant visual observation by a director, an assistant director, a teacher or an aide. LPAs advised the isolation area shall not be located in the kitchen area or the general-use toilet area. LPAs observed a working carbon monoxide detector in Room 1. LPAs were able to hear a successful test. Facility was observed with a working telephone service on the premises. Facility has written sign in/ out sheets with space provided for parent / guardian signatures. LPAs advised the licensee shall be responsible for ensuring that children with obvious symptoms of illness including, but not limited to, fever or vomiting, are not accepted. LPAs advised smoking is prohibited on the premises of a child care center as specified in Health and Safety Code Section 1596.795(b). A baby walker shall not be allowed on the premises of a child care center in accordance with Health and Safety Code Sections 1596.846(b) and (c). LPAs advised there shall be at least 35 square feet of indoor activity space per child based on the total licensed capacity. Napping: LPAs advised a standard size six-year crib or porta-crib meeting the following requirements shall be provided for each infant who is unable to climb out of a crib: Stacking wall cribs or cribs stacked one on top of another, often referred to as tiered cribs, shall not be permitted. Infant room was observed with 4 cribs and cots available. Cribs shall not limit the ability of staff to see the infant. Crib mattresses were observed to be: Covered with vinyl or similar moisture-resistant material. Crib mattresses were observed to be: Maintained in a safe condition with no exposed foam, batting or coils. LPA advised floor mats or cots that meet the requirements of Section 101239.1(b) shall be provided for all infants who have the ability to climb out of a crib. LPAs advised each crib, mat or cot shall be occupied by only one infant at a time. LPAs advised each infant's bedding shall be used for him/her only. Such bedding shall be replaced when wet or soiled, or when the crib, mat or cot is to be occupied by another infant. LPAs advised the calculation of indoor activity space for infants shall not include space designated and used page 3 for cribs. The sleeping area for infants was observed to be physically separate from the indoor activity space. Crib area was observed with a barrier from activity space with wooden frame and plexi glass that allows staff to observe sleeping infants. Cots used for napping were observed to be maintained in a safe condition. Covered with vinyl or similar material that can be wiped. Wiped with a detergent/disinfectant weekly or when soiled or wet. LPAs advised each cot shall be equipped with a sheet to cover the cot or mat and, depending on the weather, a sheet and/or blanket to cover the child. LPAs observed facility using individual sleep plans for infants and a sleeping logs to document staff checking infants every 15 minutes. LPAs observed a variety of age-appropriate equipment, toys and materials in good condition and in sufficient quantity to allow children present to fully participate in planned activities. Infant Changing Tables LPAs observed changing tables to have a padded surface no less than one-inch thick and be covered with washable vinyl or plastic. Have raised sides at least three inches high, maintained in good repair and safe condition. While in use, be placed within arm's reach of a sink. Not be located in the kitchen/food-preparation area. Restrooms: All toilets, handwashing and bathing facilities were observed to be maintained in safe and sanitary operating condition. LPAs advised additional equipment, aids and/or conveniences shall be provided as needed in centers that serve children with physical disabilities. LPAs advised hot water temperature controls shall be maintained to automatically regulate temperature of hot water delivered to plumbing fixtures used by children to attain a hot water temperature of not less than 105 degrees F (40.5 degrees C) and not more than 120 degrees F (48.8 degrees C). Notwithstanding (e) and (e)(1) above, handwashing fixtures shall not be required to deliver hot water. Per licensee the staff bathroom located in the walk through space between Rooms 1 and 2 is designated for page 4 use by children who are ill, for use by staff, and for emergency use. This toilet and handwashing fixture was observed to be conveniently located in relation to the isolation area. There shall be a minimum of one hand washing sink to every 15 infants and one potty chair to every five infants being toilet trained. Outdoor: LPAs observed the outdoor activity space to be physically separate from space used by children in the child care center components. LPAs observed a shaded rest area for the children. LPAs observed potential hazards as broken and raised asphalt, water pipe outlet observed at a level of 2 feet from the ground to be accessible to children. LPAs observed a plastic climbing structure with two swings attached to be for ages 2 years to 6 years old and a second structure for ages 2 years to 8 years old. LPAs advised all outdoor space equipment shall be age appropriate for the age range of the license. Plastic play house was observed with the plastic faucet in need of repair or replacement. The carpets in the outdoor activity space were observed in need of cleaning. LPAs advised as a condition of licensure, the areas around and under high climbing equipment, swings, slides and other similar equipment shall be cushioned with material that absorbs falls. LPAs did not observe a sandbox in the infant outdoor space. LPAs observed the playground to be enclosed by a fence to protect children and to keep them in the outdoor activity area. LPAs observed the fence to be at least four feet high. LPAs advised any construction or equipment that could pose a hazard in the outdoor activity area shall be made inaccessible to children in care. This shall include, but not be limited to, incinerators, air- conditioning equipment, water heaters, and fuse boxes. No pools or bodies of water were observed. LPAs advised there shall be at least 75 square feet per child of outdoor activity space based on the total licensed capacity. Health Related Services: Per facility medications are be kept in the office inaccessible to children. A refrigerator is available be used to store any medication that requires refrigeration. page 5 The facility was observed with a written plan to record the administration of prescription and nonprescription medications and to inform the child's authorized representative daily when such medications have been given. Food Service: LPAs advised prior to the infant's first day at the center, the infant care center director or assistant director shall complete a needs and services plan for the infant. Needs and service plans were observed in the classroom. High chairs were observed to be used to seat infants during feeding. LPAs advised Infants who are unable to sit unassisted in a high chair or other seating equipment shall be held by a staff person or other adult for feeding. Bottles, dishes and containers of food brought by the infant's authorized representative shall be labeled with the infant's name and the current date. LPAs advised the infant care center shall not serve honey or corn syrup to any infant. LPAs advised all food shall be safe and of the quality and in the quantity necessary to meet the needs of the children. Each meal shall include, at a minimum, the amount of food components as specified by Title 7, Code of Federal Regulations, Part 226.20, (Revised January 1, 1990) Requirements for Meals, for the age group served. All food shall be selected, stored, prepared and served in a safe and healthful manner. All foods or beverages capable of supporting the rapid and progressive growth of microorganisms that can cause food infections or food intoxications shall be stored in covered containers at 45 degrees F (7.2 degrees C) or less. Pesticides and other similar toxic substances shall not be stored in food storerooms, kitchen areas, food-preparation areas, or areas where kitchen equipment or utensils are stored. Soaps, detergents, cleaning compounds or similar substances shall be stored in areas separate from food supplies. All kitchen, food-preparation and storage areas shall be kept clean and free of litter and rubbish; and measures shall be taken to keep all such areas free of rodents and other vermin. page 6 Postings: LPAs observe the facility license posted in a prominent, publicly accessible location in the front of the facility. LPAs observed the following postings: LIC 613A (9/96), PUB 393 (8/02), Child Care Center Notification of Parents' Rights Poster, LIC 610 with the telephone number of the local health department and information on child passenger restraint systems pursuant to Health and Safety Code section 1596.95(g) and Vehicle Code sections 27360 and 27360.5, and LIC 9148 Contingency plans for action during fires, floods and earthquakes. Menus shall be in writing and shall be posted at least one week in advance in an area accessible for review by the child's authorized representative. Copies of the menus as served shall be dated and kept on file for at least 30 days. Menus shall be made available for review by the child's authorized representative and the Department upon request. LPA advised the licensee shall reveal each child care center license number in all advertisements in accordance with Health and Safety Code Section 1596.861. Facility representative was reminded that all adults 18 and over responsible for administration or direct supervision of staff, persons who provides care and supervision to children, and staff who have contact with children, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated. LPA discussed the safe sleep regulations with facility representative and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed facility representative of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. LPA reviewed with facility representative the LIC 311A, Records To Be Maintained At The Facility, for child’s records, personnel records, administrative records, and documents to be posted. page 7 Community Care Licensing Division (CCLD) regularly sends information to licensed facilities, providers, and stakeholders by way of Provider Information Notices (PIN), Program Quarterly Update Newsletters and other important information communication platform. The following corrections are needed before a capacity increase will be considered. Corrections are due by 10/28/2022: · Room 2 is in need of smoke detector · Declaration stating plan for enrollment restrictions due to 4 cribs. · Remove the two plastic structure that is intended for ages 2 years to 6 years old and 2 years to 8 years old. · Make outdoor water faucet inaccessible to children in care. · Repair broken and raised areas of asphalt · Outdoor rugs are in need of cleaning · Processing of outdoor waiver An exit interview was conducted with the above items discussed and a copy of this report was provided to the Facility representative, Robina Petrossian, Nancy Romero (Garza) and Armond Asadurian. Final license determination will be made upon review by the Licensing Program Manager and correction of the above issues. page 8
