What the inspector wrote

Parents are not reporting to have observed trash accessible to children in the playground. Parents are reporting that they have observed trash bags in the playground but not when children are outside. Based on the information obtained over the course of the investigation, LPA is unable to corroborate the allegation, trash is accessible to day care children. Therefore, the allegation is determined Unsubstantiated . A finding that the complaint is unsubstantiated means that although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the allegation occurred. A copy of this report, Notice of Site Visit, and Appeal Rights were explained and provided to Director/Owner Peggy Nairn. On 08/16/22, LPA Almanza observed 3 Staff (S1, S2, & S4) Change diapers for children in care. LPA did not observe Staff 1 and 2 disinfect changing table or wash hands after diaper change. LPA Almanza received a copy of the Facilities Diapering and Hand Washing Procedures. Diapering Procedures: “1. Preparing for diapering as indicated above”; “9. Place child at sink and wash hands following the “hand washing procedures””; “10. Spray diapering surface with bleach-water solution…” ; “11. Adult washes hands using the “handwashing procedure,” without contaminating any other surfaces.” Hand Washing Procedures: “All Adults In Penny & Peggy Nairn 24 hour Childcare, Inc. classrooms need to follow ALL the following steps identified below to prevent the spread of diseases to children and staff members.” “After diapering/toileting a child. After considering available information, Staff are not disinfecting changing table after diaper changes and Staff are not washing hands after diaper changes. Based on LPAs observation and interviews which were conducted and record review(s), the preponderance of evidence standard has been met, therefore the above allegation(s) is found to be SUBSTANTIATED. California code of Regulations, Title 22, Division 12 & Chapter 1, are being cited on the attached LIC9099D. During today’s visit TWO Type B violation are being issued: 1. 101428(d)(7) Infant Care Personal Services - The changing table and changing pads shall be disinfected after each use even when disposal covers are used. 2. 101438.1 (b) Infant Care General Sanitation - Each caregiver shall wash his/her hands with soap and water before each feeding and after each diaper change. The Notice of Site Visit (LIC 9213) – must remain posted for 30 days during the hours of operation after each site visit by a licensing representative. Failure to maintain posting as required will result in a civil penalty of $100.00. A copy of this Report (LIC9099 & LIC9099d), Appeal Rights (LIC9058) and Notice of Site Visit were reviewed and provided to the Director/Owner Peggy Nairn.
