Inspector’s narrative

What the inspector wrote

child did not sustain an injury as a result of the fall. The Licensee immediately replaced the chair and purchased a new set of 4 chairs. During the visit conducted on 8/23/24, LPA Katrdzhyan observed the new chairs. LPA did not observe furniture in disrepair at the time of visit. In reference to the allegation of facility being unsanitary, during a tour of the facility conducted on 8/23/24 and 11/1/24, LPA Katrdzhyan observed the outside play area and toys to be unsanitary. The toys were covered with dust, water, dirt and leaves (pictures taken). Per the Licensee, the outside toys and equipment are hosed down once a month and let to be air dried. Based on LPA’s observations and interviews conducted, the preponderance of evidence standard has been met, therefore the above allegations are found to be Substantiated. California Code of Regulations, (Title 22), are being cited on the attached LIC 9099D. The Notice of Site Visit was provided and must remain posted for 30 days during the hours of operation after each site visit by a licensing representative. Failure to maintain posting as required will result in a civil penalty of $100.00. Exit interview was conducted with the Licensee and Appeals Rights provided. During the interview with the Licensee, the Licensee denied the allegation and stated that adequate supervision is provided to children in care. During the interview with staff, staff made no disclosures about not providing adequate supervision to children in care and denied the allegations to be true. Parents interviewed did not present concerns related to the above-mentioned allegation and were pleased with the services and care being provided to their children. Based on the investigation conducted, there is insufficient evidence to support the above-mentioned allegation to be true. Therefore, although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is Unsubstantiated. The Notice of Site Visit was provided and must remain posted for 30 days during the hours of operation after each site visit by a licensing representative. Failure to maintain posting as required will result in a civil penalty of $100.00. Exit interview was conducted and report was reviewed with the Licensee and Appeals Rights provided.

This poses a potential health, safety or personal rights risk to persons in care.
