Inspector’s narrative

What the inspector wrote

 At approximately 11:00 AM, while staff members were preparing to distribute meals, Child 6 (C6) struck Child 4 (C4), resulting in C4 crying due to the impact. Although staff were present in the area, they were not visually observing or actively supervising the children at the time of the incident.  At approximately 11:41 AM during nap time, both Staff Member 1 (S1) and Staff Member 2 (S2) were observed using their personal phones. Neither staff member was visually monitoring the children, and both remained engaged with their phones throughout the observation. As a result, LPA Castellanos issued findings related to the complaint investigation. Based on LPA’s direct observations of today’s inspection it was found that there is Lack of staff supervision that resulted in a child hitting another child in care, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. Per Title 22, Division 12, Chapter 1, of the California Code of Regulations, there is one (1) deficiency cited at this time for violation of Title 22 regulation; (see LIC809-D). Upon receipt of this report, S2 shall post the Notice of Site Visit and any Licensing report documenting a Type “A” deficiency. The report and the Notice of Site Visit shall be posted for 30 consecutive days. Failure to maintain posting as required will result in an immediate $100 civil penalty. A copy of this report shall be provided to the parent/guardian of children currently enrolled by the next business day or immediately upon return. A copy of this report shall also be provided to the parent/guardian of any newly enrolled children for the next 12 months (1 year). The Acknowledgment of Receipt (LIC9224) form must be maintained in each child’s file immediately upon receipt from parent. Licensee was provided with a copy of the Acknowledgement of Receipt of Licensing Reports (LIC 9224) Form during this visit. An exit interview was conducted, and Plan of Correction was reviewed and developed with S2. A copy of this report and appeal rights were discussed and left with S2, whose signature on this form confirms receipt of these documents. Page 2

    101215.1(b) Child Care Center Directors Qualifications and Duties (b) All child care centers shall have a director.This requirement is not met as evidenced by: Based on observations (09/18/2025 & 11/07/2025) and interviews with relevant staff, it was confirmed that the facility does not have a designated Director as of September 2025.

  • PRESCHOOL PROGRAM WITH TODDLER COMPONENT

    101216.4(a)(2) Preschool Program with Toddler Component (2) The toddler program shall be conducted in areas physically separate from those used by older or younger children. Space planning and usage for the toddler component shall be governed by the provisions of Section 101438.3. Plans to alternate use of outdoor play space must be approved by the Department.This requirement is not met as evidenced by: Based on observation, interview and record review, the licensee did not comply with the section cited above: C1 18 months of age consistently commingled with seven preschool-aged children throughout the day, which poses/posed an immediatel health, safety or personal rights risk to persons in care.

    Responsibility for Providing Care and Supervision 101229(a)The licensee shall provide care...(1)No children shall be left without the supervision of a teacher at any time...Supervision shall include visual observation.This requirement is not met as evidenced by: Based on observation, the facility did not comply with the section cited above in 2 Staff Members not providing Care and Supervison to 8 children during today's inspection, which poses/posed an immediate health, safety or personal rights risk to persons in care.
