What the inspector wrote

On 11/10/2025 Licensing Program Analyst (LPA) Cristina Castellanos conducted an unannounced Plan of Correction visit at the above-mentioned address for the purpose of ensuring the standards are being met in accordance with California Tittle 22 Regulations and California Health and Safety Codes. Upon arrival LPA met with Staff members 1 & 3 (S1 & S3) and discussed the purpose of the visit. LPA then toured the facility both indoors and outdoors. At approximately 9:44 am a child was dropped off. During today’s inspection there were nine (9) children, and two adult staff members present. Licensee Cherelle Rivera arrived at the facility at approximately 12:35pm. LPA previously conducted an unannounced case management on 11/07/2025 and the facility was cited for the following deficiencies: 101216.4(a)(2) Preschool Program with Toddler Component - Type A Violation (a) Licensees serving preschool-age children may create a special program component for children who are between 18 months and 36 months of age…The provisions of Sections 101351 through 101439.1 shall apply for children between the ages of 18 and 24 months participating in a preschool toddler component,… (2) The toddler program shall be conducted in areas physically separate from those used by older or younger children. Space planning and usage for the toddler component shall be governed by the provisions of Section 101438.3. Plans to alternate use of outdoor play space must be approved by the Department. Continue 101215.1(b) Child Care Center Directors Qualifications and Duties - Type A Violation (b) All child care centers shall have a director. LPA Castellanos observed one toddler (C1) 18 months of age commingling with seven preschool-aged children from 8:20am to 9:05am. The oldest preschool-aged child present during today’s inspection is five years and 10 months old. LPA Castellanos reminded staff members of the regulation and emphasized the need for corrective action to ensure compliance is being maintained. Furthermore, there was no director present in the facility. Based on observations, record review, and staff interviews conducted during today’s inspection, it was determined that the licensee failed to correct the previously cited violations within the time specified by the Department. As a result of this continued noncompliance, civil penalties have been assessed. Specifically: · Two (2) civil penalties of $100 per violation per day have been issued. · These penalties are associated with the licensee’s failure to correct the following Type A violations : Section 101216.4(a)(2) – Preschool Program with Toddler Component Section 101215.1(b) – Child Care Center Director Qualifications and Duties An exit interview was conducted with Licensee Cherelle Rivera. During the interview, LPA reviewed the findings and discussed the outcome of the visit. A copy of the licensing report was provided to the Licensee. A Notice of Site Visit was issued and must remain posted for 30 consecutive days in a prominent location at the facility. Failure to comply with this posting requirement will result in an immediate civil penalty of $100. Page 2

    Teacher Aide Qualifications and Duties 101216.2(e) An aide shall work only under the direct supervision of a teacher.This requirement is not met as evidenced by: Based on LPA observations, record reviews, and interviews that were conducted the facility did not comply with the section cited above; from 8:20am to 9:05am, eight (8) children were present in Preschool Classroom No. 2 under the supervision of one aide (S3), which poses/posed an immediate health, safety or personal rights risk to persons in care.

  • TEACHER-CHILD RATIO

    Teacher-Child Ratio 101216.3(b) The licensee may use teacher aides in a teacher-child ratio of one teacher and one aide for every 15 children in attendance.This requirement is not met as evidenced by: Based on LPA observations, record reviews, and interviews that were conducted the facility did not comply with the section cited above and it was found that the facility was operating out of ratio, classroom 2 only had an aide an no teacher with 8 children in care, which poses/posed an immediate health, safety or personal rights risk to persons in care.
