What the inspector wrote

On 12/05/2025 Licensing Program Analysts (LPA) Cristina Castellanos and Brittany Lovest conducted an unannounced case management inspection for the purpose of ensuring the standards are being met in accordance with California Tittle 22 Regulations and California Health and Safety Codes. During today’s inspection, nine (9) children and two (2) adult staff members were present in Classroom 2. Per the facility’s license, the toddler program serves children ages 18 months to 24 months. Furthermore, LPAs Castellanos and Lovest observed one toddler (C6) 18 months of age consistently commingling with eight preschool-aged children throughout the day. The oldest preschool-aged child present during today’s inspection was five and a half years old. The commingling occurred during multiple routine activities, including arrival, lunch, and nap time. According to staff members S3 and S4 Room 1 is the designated classroom for toddlers. However, during the inspection Room 1 was not being used for C6 upon LPAs arrival. LPA Castellanos informed licensee Rivera and staff members on 11/07/2025 , 11/10/2025 and during today’s inspection that in accordance with Title 22, Regulation 101216.4(a)(2), “The toddler program shall be conducted in areas physically separate from those used by older or younger children.” The observed commingling during today’s inspection is not in compliance with this regulation. Based on observations, record review, and staff interviews conducted during today’s inspection, it was determined that the licensee failed to correct the previously cited violation within the time specified by the Department. As a result of this continued noncompliance, a civil penalty has been assessed. Specifically: Section 101216.4(a)(2) – Preschool Program with Toddler Component Type A violation Continue Per Title 22, Division 12, Chapter 1, of the California Code of Regulations, there was one (1) deficiency cited at this time for violation of Title 22 regulation; (see LIC809-D) and a Repeat Violation – An Immediate Civil Penalty of $250 was assessed. Upon receipt of this report, S3 shall post the Notice of Site Visit and any Licensing report documenting a Type “A” deficiency. The report and the Notice of Site Visit shall be posted for 30 consecutive days. Failure to maintain posting as required will result in an immediate $100 civil penalty. A copy of this report shall be provided to the parent/guardian of children currently enrolled by the next business day or immediately upon return. A copy of this report shall also be provided to the parent/guardian of any newly enrolled children for the next 12 months (1 year). The Acknowledgment of Receipt (LIC9224) form must be maintained in each child’s file immediately upon receipt from parent. S3 was provided with a copy of the Acknowledgement of Receipt of Licensing Reports (LIC 9224) Form during this visit. An exit interview was conducted, and Plan of Correction was reviewed and developed with S3. A copy of this report and appeal rights were discussed and left with S3, whose signature on this form confirms receipt of these documents. Page 2

Plans to alternate use of outdoor play space must be approved by the Department.This requirement is not met as evidenced by: Based on observation, interview and record review, the licensee did not comply with the section cited above: C6 18 months of age consistently commingled with 8 preschool-aged children throughout the day, which poses/posed an immediatel health, safety or personal rights risk to persons in care.
