What the inspector wrote

On 04/27/2026 , Licensing Program Analyst (LPA) Cristina Castellanos conducted an unannounced Case Management Inspection at the above-referenced facility to ensure compliance with California Code of Regulations, Title 22 and the California Health and Safety Code . LPA met with Staff 1 (S1) and explained the purpose of the visit. During today’s inspection, six (6) children and one (1) adult staff member were present in Classroom 2 , and three (3) toddlers and one (1) adult were present in Classroom 1. Per the facility’s license, the toddler program serves children 18 to 24 months of age . Record review, interviews, and direct observation revealed that the facility continues to commingle the toddler program with the preschool program due to insufficient staffing. § On 04/22/2026, between 3:00 p.m. and 6:00 p.m., Staff 3 (S3) was left alone with two (2) toddlers and four (4) preschool children. § As of 04/23/2026, the facility continues to operate both programs with only two (2) staff members. § During today’s inspection at approximately 11:58 a.m., LPA observed three (3) toddlers transition into the preschool classroom during nap time due to S1 taking her lunch break. At that time, six (6) preschool children were present. § Staff confirmed that from 2:00 p.m. to 6:00 p.m., children will continue to be commingled because only one (1) staff member is available. The facility is not in compliance with Title 22, Regulation 101216.4(a)(2), which states: “The toddler program shall be conducted in areas physically separate from those used by older or younger children.” Due to continued noncompliance, a civil penalty has been assessed. Violation: Section 101216.4(a)(2) – Preschool Program with Toddler Component (Type A) Between 09:03 a.m. and 09:14 a.m., LPA Castellanos observed multiple instances of lack of visual supervision: § Staff 2 (S2) left three (3) toddlers alone in Classroom 1 while she walked to the facility’s dumpster and then entered the preschool classroom. o At approximately 9:06 a.m., Child 1 (C1) exited the toddler classroom, ran into the preschool classroom after S2, and then returned to the toddler classroom unsupervised. o At no time did S2 appear to be visually observing or actively supervising the children. § At approximately 9:13 a.m., LPA observed S1 exit the preschool classroom and enter the toddler classroom, leaving seven (7) children in the preschool classroom without supervision. These observations demonstrate noncompliance with Section 101229(a)(1) – Responsibility for Providing Care and Supervision, which states: “No children shall be left without the supervision of a teacher at any time… Supervision shall include visual observation.” The licensee failed to correct previously cited violations within the required timeframe. As a result, civil penalties have been assessed. Page 2 Interviews and LPA observations indicate that the facility has not had a qualified Director since September 2025 . The facility has been previously cited for noncompliance with Section 101215.1(b) – Child Care Center Director Qualifications and Duties on: 11/07/2025, 11/10/2025 , 12/12/2025 and 03/03/2026. Continued noncompliance constitutes a Type A violation. Pursuant to Title 22, Division 12, Chapter 1 , three (3) deficiencies are cited and documented on the LIC 809-D . Upon receipt of this report, the Licensee must post the Notice of Site Visit and any licensing report documenting a Type A deficiency for 30 consecutive days . Failure to maintain required posting will result in an immediate $100 civil penalty. A copy of this report must be provided to all currently enrolled parents/guardians by the next business day or upon return. For the next 12 months, a copy must also be provided to parents/guardians of newly enrolled children. The Acknowledgment of Receipt of Licensing Reports (LIC 9224) must be placed in each child’s file upon receipt. A copy of the LIC 9224 was provided during today’s visit. An exit interview was conducted, and the Plan of Corrections was reviewed with S2. A copy of this report and appeal rights were provided to S1, whose signature acknowledges receipt of these documents. Page 3

    101216.4(a)(2) Preschool Program with Toddler Component (2) The toddler program shall be conducted in areas physically separate from those used by older or younger children. Space planning and usage for the toddler component shall be governed by the provisions of Section 101438.3. Plans to alternate use of outdoor play space must be approved by the Department.This requirement is not met as evidenced by: Based on observation, interview and record review, the licensee did not comply with the section cited above: 3 toddlers commingled with 6 preschool-aged children starting at 11:58am, which poses/posed an immediatel health, safety or personal rights risk to persons in care.

  • RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION
