What the inspector wrote

On 5/22/2026 Licensing Program Analysts (LPAs) Judy Laureano and Brittany Lovest conducted an announced case management inspection at the above-mentioned facility for the purpose of ensuring that standards are being met in accordance with California Tittle 22 Regulations and California Health and Safety Codes. The inspection aims to obtain additional information regarding the bodies of water (creek) located on the premises. LPAs met with Director Nyah Moyer and Assistant Director Kim Soria. LPAs observed 104 children and 18 staff members providing care and supervision. Present during today’s inspection were Jimmy Bradley, Building Support, Rachelle Vanderstay Director of Operations and Founder Jesse Biltz. LPAs observed and inspected the outdoor yard, specifically the creek that runs diagonally across the yard. Children engage in water play and teachers are responsible for ensuring that the creek is safe for play. Per director, ratio for the creek area will be 1 teacher to 6 children. The surface is not slippery, and children will be required to wear appropriate water shoes with grips while playing in the creek. Director confirmed staff will be stationed as need in the area. They will have at least 2 teachers present while a small group is in the creek area. Water temperature is checked by Building Support and on cold days and/or rainy days, children will not be permitted to use the area. Facility has designated building support who is responsible for the creek's maintenance. Facility also contracts with Aqua Life Ponds for monthly maintenance, which includes draining and sanitizing to decrease mold from developing in the rocks. Creek has a filtrations system that keeps the water clean. Page 2 Water cycles from water tank back to spout of the creek. Water tank is approximately 30 gallons. Facility provided LPAs with a copy of the facility’s “Creek Staff Training” that will be taken by all staff that covers procedures around the creek. In the event of rainfall, the creek’s tank was observed with a drainage that will prevent an overflow. The day-to-day cleaning of the creek is completed by Building Support. Duties include turning creek on upon arrival; testing flow and ensuring water does not exceed 1 inch in any place and ensuring creek remains free of debris. Building Support is also responsible for ensuing daily checks and monthly visits from an outside vendor are completed and documented. The creek is turned on by a battery operated remote that will be accessed by staff. The remote has an on/off switch, and the creek operates on a single setting. Creek will be turned on and off by staff when in used. Per Assistant Director, the velocity of the water cannot be changed; creek has one setting only. Once enrolled and/or registered, parents are reminded to bring extra clothing for children because of the opportunity for water play in the creek and required water shoes. The creek’s deepest point when water is running is located at the top of the creek and it measures 1/2 inch. The middle of the creek, when water is running measures 5/8 inch. The width of the bed creek: 3ft and 10 inches at the top of the creek but water line to water line measures 2ft. and 5 inches 5 ft. 7 inches at the middle of the creek but water line to water line measures 3ft. and 1 inch 4 ft. and 5 inches at the bottom of the creek but water line to water line measures 2ft. and 3 inches The creek measures 45 ft. and 7 inches long and it takes about 1 minute and 8 second for water to reach the end of the creek when water is turned on. One drain was observed at the end of the creek that drains to the water tank. Water tank was observed covered and made inaccessible by a lock. No deficiencies were cited during today’s inspection in accordance to the California Code of Regulations Title 22, Division 12, Chapter 1 and California Health and Safety Code. An exit interview was conducted, and a copy of report with Notice of Site Visit was provided to Assistant Director Kim Soria.
