On 2/27/2023 , Licensing Program Analyst (LPA) Carol Heath conducted an unannounced Required 1-Year inspection at the Guevara Family Child Care. Upon arrival, the LPA met with the licensee, Jeanette Guevara, who guided the LPA on a tour of the facility. Family members residing in the home include 1 adult (licensee) and 1 child (Licensee\342\200\231s son). Per LIS, annual facility fees are current. All adults living in the home have been background cleared. Per the licensee, the hours of operation are Monday through Friday, 7:00 a.m. to 6:00 p.m. There were 5 (1 infant,1 toddler and 3 preschool ) daycare children and 1 assistant during this inspection. Incidental Medical Services (IMS) were discussed. Per the licensee, she does not have children who need IMS. The home is set up as follows: This is a two-story Home with 4 bedrooms, 3 bathroom home with a kitchen, Family room, loft, laundry room, living/dining room, backyard, and garage. The garage is used for storage only, and no childcare activities are conducted there. The home was inspected for safety, comfort, cleanliness, telephone service, central air, and heat and ventilation. All windows have screens and are free of cracks, bugs, and debris. There is no pool, spa, or other bodies of water on the premises. Main Area: Child care is provided in the family room and downstairs bedroom. Children use the bathroom beside the downstairs bedroom. Children have access to the kitchen and backyard. Family Room/Downstairs Bedroom #1: LPA observed age-appropriate toys and furniture for the children. LPA observed: A small table was observed with a total of eight chairs. Several plastic storage bins were observed in which games and toys are stored for the children. A small play kitchen was located in the area which children could play. There are games and books on the premises of this facility. There are mats on the floor that have educational/learning activities on them. The mats were observed to be in good condition. Children's Bathroom (#1): Children use the bathroom next to the downstairs bedroom. The Bathroom was toured and inspected sink/toilet is in operable condition. The toilet and faucets are clean, safe, and operable. All poison and medications are made inaccessible to children with child safety latches on the sink cabinet and drawers. The bathroom was observed to be free and clear of hazardous items. The bathroom was clean, sanitized, and in good repair. Kitchen/Dining Room: The kitchen was inspected to ensure hazardous and dangerous items were inaccessible to children (Safety latches). Knives are kept in a butcher block on top of the refrigerator. Medications and first aid kits are kept in a key-locked upper cabinet in the kitchen. Cleaning compounds and detergents are to be kept under the child-locked kitchen sink. Off-limit : Off-limit areas include the entire upstairs, 4 bedrooms, and 2 bathrooms. LPA observed a safety gate in front of the stairs. Also, the living and dining room is gated. The garage has a safety doorknob. Backyard (Declaration): The backyard was inspected; The backyard is gated all around. The outdoor play area was observed to be free of hazards and loose and sharp parts. There is grass and a concrete area with a basketball hoop for active play. There is a large play structure (need anchored ) and small play structures. There is a padded surface underneath. The right side of the backyard is gated and used for storage. The backyard will be off-lime until the Large Structure has anchored and fix the broken fence. Others: \302\267 AC/Heating Unit / Swamp Cooler unit was observed. AC/Heating Unit is located on the right side of the home and is inaccessible to children via barrels blocking access to the unit. \302\267 Bodies of water: Pre the licensee, there is no bodies of water in the home. There is a decorative water fountain that has no water. \302\267 Electrical outlets: All unused electrical outlets are plugged in and made inaccessible to children. \302\267 Fire extinguisher (2A10BC) : LPA observed there is a required fire extinguisher (2A10BC) that is reading in Green and located in the kitchen, inaccessible to children. It meets standards established by the State Fire Marshall. \302\267 Fireplace: No fireplace in the house \302\267 Hanging window blind cords : The cords are inaccessible to children. \302\267 Incidental Medical Services (IMS): Incidental Medical Services (IMS) policy was discussed. For IMS information, see Evaluator Manual - Regulation Interpretations and Procedures for Family Child Care Homes Section 102417. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. The licensee will not be providing IMS to the children at this time. \302\267 Isolation area (Illness): Per the licensee, if the child shows signs of illness, he/she will be separated from other children and stay in Bedroom #1 \302\267 Medications and cleaning solutions : Medications and cleaning solutions : Medications and first aid kits are kept in a key-locked upper cabinet in the kitchen. Cleaning compounds and detergents are to be kept under the child-locked kitchen sink. \302\267 Napping: Children will nap in the designated nap areas with adult supervision. There are cots available for napping children stored in the downstairs bedroom closet. LPA observed 8 cots, 2 cribs, and 1 playpen. LPA observed a crib and changing table in the downstairs bedroom, which is used for napping. \302\267 Pets: No Pets in this facility \302\267 Phone service: There is a working landline or cell phone \302\267 Smoke Detectors and Carbon Monoxide: The smoke detectors and carbon monoxide devices tested operable. \302\267 Stairs (For two-story hours): There is a safety gate barricaded to make the stairs inaccessible to the children. \302\267 The First Aid kit is located in the key-locked kitchen cabinet, inaccessible to children. The First Aid Kit was observed to be complete with supplies and a first aid manual . \302\267 Transportation : The licensee does provide transportation for children. The licensee has a valid California driver's license, valid vehicle insurance, and vehicle registration. \302\267 Weapons or Firearms: Per the licensee, there are No Firearms at the facility at this time. LPA does not observe any firearms. \303\230 Documentation: \302\267 Child files : LPA reviewed 5 children's records. The records are incomplete and missing forms. 3 of 5 children does not have IZ record. \302\267 CPR/First Aid: LPA observed licensee has current Pediatric CPR and First Aid Training with an expiration date (08/2023) 1 hour of nutrition training, (8) hours of Preventive Health and Safety Training. \302\267 Facility Roster: LPA observed Child Care, Facility Roster. Per Licensing Information System, annual facility fees were current. \302\267 Fire Drill and Disaster Drill: Per the licensee, fire and disaster drills are conducted every 6 months; the last drill was documented and conducted on 12/4/22. \302\267 Immunization: The licensee has the required immunizations. The licensee provided a written statement declining the influenza vaccination. \302\267 Infant Sleeping Plan (LIC 9227): LPA shared the information with the licensee . LPA also shared the Safe Sleep regulation. Per Licensee, there is 1 infant (7 months) enrolled in the facility. Licensee did not have LIC9227 and sleeping log. \302\267 Mandated Reporter Training: The licensee has completed the online mandated reporter training at www.mandatedreporterca.com , and will renew on 10/27/2024 \302\267 Staff Personnel File: LPA observed 1 staff information. \302\267 Staffing Ratio and Capacity: This is a small family childcare facility. LPA observed 5 children (1 infant, 1 toddler and 4 preschools) during the inspection. \303\230 The following information was discussed with the licensee : \303\274 Mandatory Forms for the children's files and provider's files. \303\274 Requirements for fire drills, earthquake drills, and documentation for both. \303\274 The licensee is reminded that 100% supervision is required for children at all times. \303\274 Capacity requirements, Roster requirements, Posting requirements, Documentation requirements for disaster drills (fire and earthquake). Mandatory Forms for the children's files and provider's files, and Safe Sleep Awareness. The role and responsibilities of being a mandated reporter were reviewed. The licensee was reminded that supervision is always required for children in care. \303\274 Licensee was made aware that it is their responsibility to know the regulations as well as anyone who assists in providing care. Licensee was advised that the inaccessibility of hazards must be constantly reassessed depending on the children in care. Licensing must always have the facility's phone number; if the phone number is changed, licensing must be notified. \303\274 Licensee was advised of the requirement to report unusual incidents and/or injuries to the parent/guardian and Licensing within the time frame specified by the regulation and on the form LIC624B \303\274 The licensee was informed of the responsibility to report suspected Child Abuse by calling the Child Abuse Hot-line at 1-800-540-4000. Also, call the CCL office and follow up with a written Unusual Incident/Injury Report (LIC 624B). \303\274 Criminal Record Statement: Licensee [or facility representative] was reminded that all adults 18 and over living or working in the home, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to the initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated. \303\274 Safe Sleep: LPA discussed the safe sleep regulations with licensee [or facility representative] and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee [facility representative] of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. \303\274 Notice of Site Visit: A notice of site visit was given and must remain posted for 30 days. \303\274 Posting Requirements: Failure to comply with posting requirements shall result in an immediate civil penalty of $100. \303\274 The regulation prohibits the smoking of tobacco in a private residence that is licensed as a family childcare home and in those areas of the family childcare home where children are present (24/7 ban). \303\274 State law prohibits baby walkers, bouncy seats, exersaucer, and any other items that fall into that category. \303\274 Licensee was advised to visit the CCL website ( www.ccld.ca.gov ) to obtain updates of courses and updates/changes to the regulations. n Our Quarterly updates come out every 3 months they are also now in Spanish please log in to the CCLD website or you can email our advocates to have the quarterly updates sent directly to your email. Deficiencies cited: (See LIC 809D). The following Type A/B deficiencies are being cited in accordance with Title 22 of the California Code of Regulations and/or Health & Safety codes.
